D~VELOPMENT AGREEMENT - JENSON ADDITION <br /> <br />WHEREAS, approval of the Final Plat is given pursuant to the <br /> <br />City's Subdivision Code Section 170.0317, entitled "Division or <br /> <br />Consolidation of Unplatted Lots"; and <br /> <br />WHEREAS, no expenditure of CITY funds, will be made until the <br /> <br />City Code escrow requirements have been fulfilled by DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Dedication of Drainage and Utility Easements. Drainage <br />and utility easement shall be dedicated to the CITY as <br />shown on the Final Plat. <br />~rading and Drainage. Grading and drainage o~th~e lots <br />in the plat shall be constructed as shown on'Site Plan <br />of the Plat, which consists of one sheet, is dated July, <br />1990 and drawn by Taylor Land Surveyors, Inc. <br /> <br />Restoration. DEVELOPER shall restore all turf disturbed <br />areas, including ditches, grading, backslopes, drainage <br />and turf establishment by seeding the ditch areas which <br />may be disturbed as a result of development of the lots <br />in the Plat. Said restoration to include such additional <br />items as the CITY Engineer may direct. <br /> <br />II. <br /> <br />GENERAL <br /> <br />Park Dedication. Park dedication shall be satisfied by <br />the DEVELOPER paying to the CITY for deposit in its park <br />run, the sum of $1,500.00 which is $500.00 for each newly <br />cre~ted lot. Said sum shall be paid to the CITY prior <br />to the Final Plat being released for recording. <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the <br />introduction and.spread of tree disease into the residue <br />tree populations of the Plat and adjoining properties and <br />reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties.
