EASEMENT ACQUISITION AND ASSESSMENT AGREEMENT <br /> McKINLEY STREET EXTENSION <br /> <br /> By: William K. Goodrich, City Attorney and <br /> David Hartley, City Administrator <br /> <br />BACKGROUND: <br /> <br />In 1987 the city installed trunk sanitary sewer between the City <br />of Anoka border and Sunfish Lake Blvd. This sanitary sewer trunk <br />was located approximately 300 feet north of the Burlington Northern <br />Railroad in order to utilize the same right-of-way as the future <br />extension of McKinley Street. <br /> <br />By previous action the Council has authorized building of Mckinley <br />Street with tax increment financing. <br /> <br />The sanitary sewer crossed the Ramsey 67 Industrial Park and the <br />Leonard Spohn property. At that time, the landowners signed <br />waivers of trespass to allow for the construction of the sanitary <br />sewer. Since that time, the landowners have been reluctant to sign <br />permanent easements for the sewer and the McKinley Street extension <br />without a commitment from the City regarding assessments and the <br />construction of the McKinley Street extension. <br /> <br />As you may recall, preliminary discussion between Mr. Spohn and Mr. <br />Eggum, representative of the Ramsey 67 Industrial Park and City <br />staff have resulted in the landowners being agreeable to the <br />following conditions in exchange for the necessary 80' wide right- <br />of-way. <br /> <br />The city will construct a street and storm sewer system <br />along the right-of-way using tax increment financing. <br /> <br />The city will install watermain prior to constructing the <br />street. <br /> <br />The landowners will not be assessed for the street since <br />it will be paid for by tax increment financing. <br /> <br />o <br /> <br />The cost of trunk watermain or sanitary sewer will not <br />be assessed, however, at the time the land is developed, <br />the developers will be required to pay a service <br />availability surcharge (SAS) at the time connection is <br />made to the utilities. In addition, the landowners will <br />need to pay for any sewer and water laterals they deem <br />necessary for development of their property. <br /> <br /> <br />
