Councilmember <br />resolution and moved for its adoption: <br /> <br />introduced the following <br /> <br />RESOLUTION %90-12- <br /> <br />RESOLUTION AUTHORIZING CITY TO ENTER INTO AN EASEMENT ACQUISITION <br />AND ASSESSMENT AGREEMENT FOR THE McKINLEY STREET EXTENSION. <br /> <br /> WHEREAS, the City Council of the City of Ramsey has <br />constructed a sanitary sewer trunk along the proposed McKinley <br />Street extension as Improvement Project 87-19; and <br /> <br /> WHEREAS, City Staff has negotiated a proposed agreement for <br />the acquisition of an 80' wide right-of-way for the McKinley Street <br />extension as follows: <br /> <br />The City at its expense will construct a street and storm <br />sewer system along the right-of-way using tax increment <br />financing. <br /> <br />The City at its expense will install watermain prior to <br />constructing the street. <br /> <br />The landowners will not be assessed for the street <br />construction since it will be paid for by tax increment <br />financing. <br /> <br />The cost of trunk watermain or sanitary sewer will not <br />be assessed to benefiting property owners, however, at <br />the time the land is developed, the developers will be <br />required to pay a service availability surcharge (SAS) <br />when connection is made to the utilities. The landowners <br />will be responsible, at their own expense, for the <br />construction of any water and sewer laterals needed for <br />their respective future land development. <br /> <br />In return for the City's commitments contained in items <br />one and two above, the landowners will convey to the City <br />marketable title to the necessary 80' right-of-way. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE RAMSEY CITY COUNCIL, AS <br />FOLLOWS: <br /> <br /> 1. That the City Council hereby authorizes the City Attorney <br />to prepare easement acquisition and assessment agreements between <br />the City and the landowners (Mr. Spohn and Ramsey 67 Industrial <br />Park) based upon the terms stated above. <br /> <br /> <br />
