CASE# <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR GRADING, MINING <br />AND EXCAVATION; CASE OF GEOFFREY BRIDWELL <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Geoffrey Bridwell is requesting a conditional use permit to mine and excavate a maximum of <br />25,000 cubic yards of material from Lot 3, Block 1, Lutz Ramsey Acres. Mr. Bridwell is <br />proposing to sell the material to Dresel Contracting for use as fill material needed in City of <br />Ramsey Improvement Project #8%04, extension of 153rd Avenue N.W. Since the 153rd Avenue <br />N.W. improvement project abuts Mr. Bridwell's property, there will be no need for trucks to use <br />any other City and County roads as haul routes in the excavation process. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br /> <br />Site location map <br />Existing topography <br />Grading Plan <br />Engineer's review letter dated November 29, 1990 <br />Letter from David and Nadine King received November 29, 1990 <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />On November 13, 1990, the City received an application from Geoffrey Bridwell for a conditional <br />use permit for grading, mining and excavation. <br /> <br />On December 4, 1990, the Planning and Zoning Commission conducted a public hearing and <br />reviewed the request. Adjacent property owners were present and expressed concern with the <br />amount of soil to be removed from the site and the preservation of mature oak trees in the area. It <br />was noted that it will be necessary for the applicant to submit a revised grading plan with slopes <br />that do not exceed 12% and that 25,000 yards of material is an excessive estimate under a 12% <br />slope limit. With respect to mature trees in the area, the proposed conditional use permit was <br />amended to require that all oak u-ees along the marsh edge would be preserved. <br /> <br />R ecomm en da ti on: <br /> <br />The Planning and Zoning Commission and City Staff recommend approval of the request for a <br />conditional use permit for grading and mining pursuant to the Engineer's review dated November <br />29, 1990 and submittal of a revised grading plan that meets with the approval of the Engineer. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact __ relating to Mr. Geoffrey Bridwell's request for a conditional <br />use permit to mine and excavate materials from Lot 3, Block 1, Lutz Ramsey Acres. <br /> <br />-and- <br /> <br /> <br />
