Case No.~ <br /> <br />DENNIS LIEKVOLL CLAIM FOR DAMAGES <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />BACKGROUND: <br /> <br />Mr. Dennis Liekvoll lives at 5803 153rd Avenue NW. In 1975 and <br />1976, the city widened and improved 153rd Avenue in front of Mr. <br />Liekvoll's property. The City acquired permanent and temporary <br />easements for the increased right-of-way from Mr. Liekvoll. During <br />the construction process, Mr. Liekvoll claims that the City's <br />contractor damaged his septic system. The City Building Inspector <br />and the City Engineer's inspector reviewed the construction at the <br />time and did not find any evidence that there was damage caused to <br />the septic system. Mr. Liekvoll continues to claim damage, City <br />Staff advised him that we feel the City is not liable for any <br />damages to him. Enclosed is a May 30, 1989 letter which I wrote <br />to Mr. Liekvoll. <br /> <br />Mr. Liekvoll is not satisfied with staff's response and would like <br />to discuss this issue with the Council. You should be advised that <br />legally, any damage claim by Mr. Liekvoll at this time is most <br />likely barred by the statute of limitations and the City has no <br />obligation to pay damages to Mr. Liekvoll. <br /> <br />ENCLOSURE: <br /> <br />May 30, 1989 letter addressed to Mr. Liekvoll. <br /> <br />COUNCIL ACTION: <br /> <br />Action will be based upon your discussions with Mr. Liekvoll. <br /> <br />Review Checklist: <br /> <br /> Administrator <br /> Attorney <br /> Engineer <br /> <br />47 <br /> <br /> <br />
