Motion by Commissioner Thorud and seconded by Commissioner Deemer to amend Item #48 of the proposed Findings of Fact to indicate that the proposed use will not create excessive additional requirements at public cost for public facilities. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend Item #49 of the proposed Findings of Fact to indicate that the proposed use will not involve uses, activities,' processes, etc. that will be detrimental to persons or property by reason of production of traffic, noise, smoke, fumes, glare or odors. Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend that City Council adopt the proposed Findings of Fact as amended relating to Mr. Glen Rychner's request for a conditional use permit. Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer and LaDue. Voting No: Commissioner Hendriksen. Absent: Commissioners Terry and Bawden. Motion by Commissioner Deemer and seconded by Commissioner LaDue that based on the Findings of Fact, the Planning and Zoning Commission concludes that the proposed use does comply with the requirements of the City Code, Section 170.013D and accordingly, recommends approval of the application for a conditional use permit by Aluminum Recycling, Inc. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue and Deemer. Voting No: Commissioner Thorud and Hendriksen. Absent: Commissioners Terry and Bawden. The Commission proceeded to review the proposed terms of the conditional use permit. Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend the proposed Conditional Use Permit to eliminate Item #1 which sets a term on the permit of five (5) years and amend the language of the permit to indicate that the permit will remain in effect so long as the conditions imposed are complied with. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend the proposed Conditional Use Permit to reflect a legal description of the subject property that will be inclusive of the additional property the applicant is proposing to purchase. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. It was noted that the City Attorney was provided with a copy of the proposed conditional use permit and staff has not received any comment from him as of yet. The Commission recessed at 9:35 p.m.
