Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. <br /> <br />Motion by Commissioner Thorud and seconded by Commissioner Deemer to amend Item #48 of <br />the proposed Findings of Fact to indicate that the proposed use will not create excessive additional <br />requirements at public cost for public facilities. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend Item #49 of <br />the proposed Findings of Fact to indicate that the proposed use will not involve uses, activities,' <br />processes, etc. that will be detrimental to persons or property by reason of production of traffic, <br />noise, smoke, fumes, glare or odors. <br /> <br />Motion carrieA. Voting Yes: Chairman Zimmerman, Commissioners Deemer and La.Due. Voting <br />No: Commissioners Thorud and Hendriksen. Absent: Commissioners Terry and Bawden. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend that City <br />Council adopt the proposed Findings of Fact as amended relating to Mr. Glen Rychner's request <br />for a conditional use permit. <br /> <br />Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer and LaDue. <br />Voting No: Commissioner Hendriksen. Absent: Commissioners Terry and Bawden. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue that based on the <br />Findings of Fact, the Planning and Zoning Commission concludes that the proposed use does <br />comply with the requirements of the City Code, Section 170.013D and accordingly, recommends <br />approval of the application for a conditional use permit by Aluminum Recycling, Inc. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue and Deemer. Voting <br />No: Commissioner Thorud and Hendriksen. Absent: Commissioners Terry and Bawden. <br /> <br />The Commission proceeded to review the proposed terms of the conditional use permit. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend the proposed <br />Conditional Use Permit to eliminate Item #1 which sets a term on the permit of five (5) years and <br />amend the language of the permit to indicate that the permit will remain in effect so long as the <br />conditions imposed are complied with. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. <br /> <br />Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend the proposed <br />Conditional Use Permit to reflect a legal description of the subject property that will be inclusive of <br />the additional property the applicant is proposing to purchase. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. <br /> <br />It was noted that the City Attorney was provided with a copy of the proposed conditional use <br />permit and staff has not received any comment from him as of yet. <br /> <br />The Commission recessed at 9:35 p.m. <br /> <br /> <br />
