DEV~LOpMENT AGREEMENT - NORT~FORK LINKS ADDITION <br /> <br />III. <br /> <br />P~RK DEDICATION <br /> <br />Land Dedic&tion and Cash Payment. Park Dedication shall <br />be satisfied by the DEVELOPER dedicating to the CITY <br />those areas shown as Park I and Park 2 on the Final Plat. <br />This Park Dedication is pursuant to that certain Park <br />Development Agreement entered into between the parties <br />hereto for the entire NORTHFORK P.U.D., dated <br />and amended . In addition to the <br />land dedication, the DEVELOPER shall also pay to the CITY <br />the sum of $7,000.00 which is the amount required by City <br />Code payable at the rate of $500.00 for each of the 14 <br />lots platted in the Plat. <br /> <br />IV. <br /> <br />GENERAL <br /> <br />Bridge Construction. As a part of its project, DEVELOPER <br />proposes the construction of a bridge over 153rd Avenue <br />N.W. for the purpose of connecting Lot 1, Block 2 and <br />Lot 10, Block 3 of the Plat. The CITY agrees to the <br />bridge construction based on the terms and conditions <br />described in this Agreement. This will be a private <br />walking bridge for use by golfers and golf course <br />maintenance personnel only. The bridge will be <br />constructed in accordance with Minnesota Deptartment of <br />Transportation specifications. The bridge plans will be <br />presented to the City Engineer for review and approval <br />prior to construction. Said review shall include <br />approval of architectural design both for aesthetic as <br />well as safety purposes. The bridge structure will be <br />permitted by the CITY to encroach a maximum of ten feet <br />on either side of the 153rd Avenue N.W. right-of-way. <br /> <br />Prior to use of the bridge, the DEVELOPER shall present <br />a report to the CITY by a qualified Bridge Engineer which <br />shall certify to the CITY that the bridge has been <br />properly designed and constructed and is safe for its <br />intended purpose. In addition, prior to the Bridge use, <br />the DEVELOPER will provide the CITY with a hold harmless <br />agreement, holding the CITY harmless from any and all <br />causes of action of whatever nature or kind, which may <br />be asserted against the CITY whereby the bridge is <br />alleged to be a source of damage to any person or <br />property. In addition, the DEVELOPER shall annually <br />present to the CITY evidence of liability insurance in <br /> <br /> <br />
