Councilmember moved the adoption of the following findings of fact: <br /> <br />I <br />I <br /> <br />o <br /> <br />10. <br /> <br /> PROPOSED FINDINGS OF FACT <br />CONDITIONAL USE PERMIT FOR STORAGE OF COMMERCIAL VEHICLE <br />PIN 24-32-25-33-0001 <br />5566 152ND AVENUE N.W. <br />2/6/91 <br /> <br />That David Pehlke, hereinafter referred to as "Applicant", has properly applied for a <br />conditional use permit to store a commercial vehicle in the R-1 Rural Residential District. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 (Conditional Use Permits) on February 5, 1991 and <br />that said public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />That the subject property is generally known as 5566 152nd Avenue N.W. and is legally <br />described as follows: <br /> <br />That part of the Southwest Quarter of Section 24, Township 32, Range 25 described as <br />follows: At a point on the west line of said Southwest Quarter, said point being 1208 feet <br />south of the northwest comer of said Southwest Quarter and said point also being the <br />intersection of said west line with the centerline of 152nd Avenue N.W., according to the <br />plat of Gorhams Addition, extended westerly, thence south on the said west line of the <br />Southwest Quarter for a distance of 259.4 feet, thence east at right angles 140 feet, thence <br />north at right angles 311.1 feet, thence west at right angles 140 feet to the said west line of <br />the Southwest Quarter, thence south 51.7 feet to place of beginning, together with an <br />easement for road purposes over the said 152nd Avenue N.W. extended westerly to the <br />east line of above described tract. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately one (1) acre <br />in size. <br /> <br />That the Applicant is also fee title owner of the two adjacent parcels to the north and to the <br />south which are also zoned R-1 Rural Residential and approximately one acre in size each. <br /> <br />That the surrounding properties are also zoned R-1 Rural Residential. <br /> <br />That Section 9.11.10 (Off Street Parking) of the Ramsey City Code states that no more <br />than one 1-ton motor vehicle bearing a commercial license shall be parked or stored in a <br />residential district except when loading, unloading or rendering a service. <br /> <br />That the Applicant provides septic system pumping service to the public and is requesting <br />City approval to maintain his 2-ton pumping track at his residence. <br /> <br />That there is currently one other similar permitted conditional use existing within the R-1 <br />Rural Residential District. The City of Ramsey issued a conditional use permit to PIN 14- <br />32-25-31-0028 in 1989 that included on-site storage of commercial vehicles relating to <br />firewood sales. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use, or to the public welfare. <br /> <br /> <br />
