Consent Agenda <br /> <br /> INTRODUCTION OF ORDINANCE <br /> CONVEYING A 20' STRIP OF <br />LAND WITHIN FLINTWOOD HILLS 5TH ADDITION <br /> <br />BY WILLIAM K. GOODRICH, CITY ATTORNEY <br /> <br />BACKGROUND: <br /> <br /> You will recall that at your meeting on February 12, <br />1991, the Council approved the Final Plat of Flintwood Hills <br />5th Addition contingent on certain items being completed. <br />One of those items was the conveyance by the City of its <br />20-foot strip of land which lies within proposed Lots 5 and <br />6 of the Plat. The City acquired fee title to this property <br />in 1976, apparently for the purpose of a drainage and utility <br />easement. The City Engineer has advised you that this property <br />is no longer necessary to be retained for City use, as alter- <br />nate drainage and utility easements have been provided. <br /> <br /> Pursuant to City Charter, an ordinance must be adopted <br />before the City can convey land and/or its property interests. <br />A "vacation" proceeding is not necessary, since the City <br />has .fee title to this property and it was not dedicated for <br />any specific purpose. I am therefore attaching a proposed <br />ordinance for your review and introduction. The following <br />motion is presented for your consideration: <br /> <br />COUNCIL ACTION: <br /> <br /> Motion to introduce Ordinance No. 91- which is an ordi- <br />nance authorizing the conveyance of the City's 20-foot strip <br />of land to N.D.H.,Inc. which property is described as follows: <br /> <br />The East 20 feet of the West 930 feet lying Southerly <br />of the North 481.82 feet and lying Northerly of the center <br />line of Industry Avenue of the Northwest 1/4 of the Northwest <br />1/4 of Section 36, Township 32, Range 25, Anoka County, Minne- <br />sota, said distances being measured parallel with the North <br />and West line of said Northwest 1/4 of the Northwest 1/4. <br /> <br /> <br />
