CASE

REQUEST FOR A CONDITIONAL USE PERMIT TO MAINTAIN A
COMMERCIAL VEHICLE LARGER THAN ONE TON IN A RESIDENTIAL
DISTRICT; CASE OF DAVID PEHLKE
By: Zoning Administrator Sylvia Frolik

Background:

Section 9.11.10 (Off-Street Parking) of the Ramsey City Code states that no more than one 1-ton
motor vehicle bearing a commercial license shall be parked or stored in a residential district. David
Pehlke is starting his own septic system pumping service and is seeking City approval to store his
two-ton pumper track at his home. The subject property is one acre in size, however, Mr. Pehlke
also owns the adjacent parcels to the north and south for a total of approximately 3 acres. Mr.
Pehlke does not have an accessory structure that would accommodate storing the truck indoors.

The following items are enclosed for your information:

a)
b)
c)

d)
e)

Site location map
Site plan
Planning and Zoning Commission public hearing and regular meeting minutes dated
February 5, 1991.
Proposed Findings of Fact
Proposed Conditional Use Permit

Observations:

On January 18, 1991, the City of Ramsey received an application from David Pehlke for a
conditional use permit to maintain a commercial vehicle larger than one ton on his property.

On February 5, 1991, the Planning and Zoning Commission conducted a public hearing regarding
Mr. Pehlke's request.

During the Planning and Zoning Commission's review of Mr. Pehlke's request, it was noted that
Mr. Pehlke's property is substandard because it does not have 200 feet of frontage on a public road
as 152nd Avenue N.W. dead-ends at Mr. Pehlke's property. The Commission consensus was that
it would be appropriate for the City to require property being brought up to standard when there is
a subdivision request but not when it is a conditional use permit that is being addressed. As a
result, after the Commission completed its review and recommendation regarding the request for a
conditional use permit, they did pass a motion to recommend that City Council research the
possibility of obtaining from Mr. Pehlke a 66 foot future street easement between PIN 24-32-25-
32-0006 and 24-32-25-33-0001.

There is one other similar permitted conditional use in the City. In 1989, the City issued a
conditional use permit for a firewood sales business in the Rural Residential District. That
particular conditional use permit included storing relating commercial vehicles on the property.
