REAL PROPERTY ACQUISITION AND <br />MUNICIPAL STREET AND UTILITY IMPROVEMENT AGREEMENT <br /> <br /> THIS AGREEMENT is made between ANOKA 67 INDUSTRIAL <br />PARTNERSHIP, a partnership comprised of Marvel G. Eggum, David J. <br />Krenz, Orrin Christenon and Koltes Bros., whose address is c/o Mr. <br />Marv Eggum, 15708 Judicial Road, Burnsville, MN 55337, hereinafter <br />"LANDOWNER" and the CITY OF RAMSEY, a municipal corporation, <br />hereinafter "CITY". <br /> <br /> WHEREAS, the CITY has installed sanitary sewer trunk lines <br />through a portion of LANDOWNER,S property, which property is Outlot <br />"A" RAMSEY 67 INDUSTRIAL PARK FIRST ADDITION; and <br /> <br /> WHEREAS, in 1988, LANDOWNER permitted CITY to construct the <br />sewer trunk line on its property pursuant to a Waiver of Trespass <br />Agreement between the parties hereto; and <br /> <br /> WHEREAS, the Waiver of Trespass Agreement reserves the <br />LANDOWNER'S right to compensation for damages to its property as <br />a result of the sewer trunk line construction; and <br /> <br /> WHEREAS, the CITY desires to construct a street and storm <br />sewer system over and across a portion of LANDOWNER,S property <br />using the same alignment as that for the sewer trunk line, the new <br />street to be hereinafter referred to as McKinley Street; and <br /> <br /> WHEREAS, the CITY desires also to install a municipal water <br />trunk line within LANDOWNER,S property to be located within the <br /> <br /> <br />
