II. IMPROVEMENTS TO BE CONSTRUCTED BY THE CITY 4. ~pecific Improvements: as Construction of McKinley Street Extension. The CITY will cause to be constructed a street to conform to existing Municipal State Aid (MSA) specifications including concrete curb and gutter on the McKinley Street Right- of-Way° The street shall be known as McKinley Street and will be constructed following installation of the utilities and no later than December 31,1991o Fire Hydrants. Fire hydrants shall be installed along McKinley Street at the time of utility construction with maximum spacing of 500 feet apart. Sanitary Sewer, Water and Storm Sewer. The CITY will construct within the McKinley Street right-of-way watermain and storm sewer facilities. In addition as previously stated, the sanitary sewer trunk already is constructed and located within said right-of-way. III o LANDOWNERIS PAYMENT FOR THE UTILITY IMPROVEMENTS Sanitary Sewer and Water Utility Availability Pavmentso At the time connection is made to the sewer and water utilities to be constructed in the McKinley Street right-of-way, LANDOWNER or its assigns will pay the CITY'S then current S°A.S. for sanitary sewer trunk and water trunk availability. The CITY'S 1990 S.A.S charge for this benefit was $7,463.00 per acre of commercial or industrial property. Said present surcharge is adjusted annually based on the Engineering News Record Cost Index° The principal amount of the SoA.S. plus accrued interest will be paid over a ten (10) year term. In addition, the LANDOWNER will pay to the CITY any water and sewer lateral utility benefits commence to accrue at the time of connection to the water and sewer system° I I I ! i I i I I I I I I I !
