WALTER SCROGGINS LAND SUBDIVISION <br />By: Steve Jankowski, City Engineer <br /> <br />CASE <br /> <br />Background: <br /> <br />Mr. Walter Scroggins is the owner of a parcel in excess of 100 acres, a portion of which was <br />severed by the construction of 153rd Avenue N.W. between Sunfish Lake Boulevard N.W. and <br />C.S.A.H. 5, creating a triangular parcel approximately 2.5 acres in size (see attachment A). Mr. <br />Scroggins indicates that he cannot reasonably use this severed parcel for agricultural purposes as <br />he has in the past and wishes to sell the parcel to the adjacent property owner to the north for <br />consolidation with that parcel. <br /> <br />Ordinarily, Mr. Scroggins would need to follow the subdivision rules for minor subdivision which <br />would require Planning and Zoning Commission reviews, a public hearing and park dedication <br />requirements. However, in this case, the parcel has been created as the direct result of a public <br />action, the building of the roadway. Following the prescribed procedure at this point would allow <br />no real input for its intended purpose, namely planning. In addition, the parcel created would be <br />smaller than the minimum parcel size of 10 acres for R-1 zoning in the Urban Reserve Zone. <br /> <br />Because this action is inconsistent with specific language contained within the City Code, I believe <br />the City Council should grant approval of this subdivision only after recognizing the unique <br />circumstances involved. <br /> <br />Recommendations: <br /> <br />recommend adopting the attached resolution authorizing the subdivision of the subject property. <br /> <br />Review Checklist: <br /> <br />City Engineer <br />City Attorney <br />Acting City Administrator <br /> <br />CC:03/13/91 <br /> <br /> <br />
