A public hearing was held on 3/21/91 at which no persons expressed any concerns <br />or negative comments. The Planning and Zoning Commission in subsequent case <br />discussion on 3/21/91 voted to recommend approval of the CUP with no commission <br />member opposed. <br /> <br />Enclosed for your information are the following: <br /> <br />2. <br />3. <br />4. <br />5. <br /> <br />Vicinity map. <br />Applicant's submittal. <br />Draft Findings of Fact. <br />Draft conditions of CUP. <br />Indemnification agreement. <br /> <br />Observations: <br /> <br />No building permit can be issued for the site until 142nd Street and Limonite are <br />constructed under the current development agreement. The Applicant's traffic <br />projections indicate nearly 29,000 vehicle movements per year (92/day). <br /> <br />The Applicant has stated in his application that approximately 90% of the metal <br />received would be aluminum (by volume). Other metal received will be copper, brass, <br />stainless steel and other non-hazardous metals. <br /> <br />The Applicant has indicated that copper, brass, stainless steel and other non- <br />hazardous metals would only be received incidental to the aluminum feedstock. <br /> <br />The City Attorney indicates that the indemnification agreement should be personally <br />binding on the Permit Holder as well as binding the corporation. <br /> <br />Staff Recommendation: <br /> <br />Based on the adoption of findings a motion to approve the CUP is recommended. <br /> <br />City Council Action Required: <br /> <br />Motion to adopt Findings of Fact. <br />Motion to modify approve/deny a CUP for an aluminum processing plant. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />Zoning Administrator <br />City Engineer <br />City Attorney <br /> <br />CC Mtg. 3/26/91 <br /> <br /> <br />
