Anoka County Contract # 900264-A <br /> <br />JOINT POWERS AGREEMENT <br /> <br /> THIS AGREEMENT made and entered into on February 26, 1991, notwithstanding the date <br />of the signatures of the parties, between the COUNTY OF ANOKA, State of Minnesota, hereinafter <br />referred to as the "COUNTY", and the CITY OF RAMSEY, hereinafter referred to as the "MUNICIPALITY". <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, Anoka County has taken the necessary steps to qualify for SCORE funds <br />pursuant to Minn. Stat. § 115A.557; and <br /> <br /> WHEREAS, the County has received $352,681.00 in said SCORE funds from the State of <br />Minnesota; and <br /> <br /> WHEREAS, the County wishes to assist the Municipality in meeting recycling goals set forth <br />in the Anoka County Solid Waste Master Plan by providing said SCORE funds to cities and townships <br />in the County for solid waste recycling programs; and <br /> <br /> WHEREAS, the parties are authorized and empowered to enter into this Agreement pursuant <br />to Minn. Stat. Sections 471.59 and 473.811, Subd. 7. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants and promises contained in this <br />Agreement, the parties mutually agree to the following terms and conditions: <br /> <br />PURPOSE. The purpose of this Agreement is to provide for cooperation between the County <br />and the Municipality to implement solid waste recycling programs in the Municipality. <br /> <br />TERM. The term of this Agreement is from January 1, 1991 through June 30, 1991, unless <br />earlier terminated as provided herein. <br /> <br />PROGRAM. The Municipality shall develop and implement a residential solid waste recycling <br />program adequate to meet one-half of the Municipality's annual recycling goal of 650 tons <br />as established by the County. "Recycling" means the process of collecting and preparing <br />recyclable materials and reusing the materials in their original form or using them in <br />manufacturing processes that do not cause the destruction of recyclable materials in a <br />manner that precludes further use. "Recyclable materials" means materials that are separated <br />from mixed municipal solid waste for the purpose of recycling, including paper, glass, <br />p'lastics, metals, and vehicle batteries. Refuse derived fuel or other material that is destroyed <br />by incineration is not a recyclable material. <br /> <br />REPORTING. The Municipality shall submit the following reports semiannually to the County <br />no later than July 20, 1991: <br /> <br />An accounting of the amount of waste which has been diverted from landfills as a <br />result of the Municipality's activities and the efforts of other community programs, <br /> <br />q5 <br /> <br /> <br />
