I <br />I <br />I <br /> <br /> CASE:3 <br /> REQUEST TO AMEND THE BUSINESS AND RESIDENTIAL DISTRICT <br /> ZONING BOUNDARIES IN THE PROPOSED PLAT OF FAYE 2ND ADDITION~ <br /> CASE OF FAYE CONSTRUCTION <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Faye Construction is proposing to develop the plat of Faye 2nd Addition. The plat consists of <br />approximately 103 acres and is proposed to be developed with commercial activity adjacent to <br />Hwy. #10 and single family residential development south to the Mississippi River, as currently <br />zoned for. However, Faye Construction has requested a rezoning to realign the district boundary <br />between the commercial and residential portions of the property to coincide with the preliminary <br />plat that has been submitted for approval. <br /> <br />I <br />I <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Applicant's proposed zoning amendment <br />Proposed £mdings of fact <br />Proposed ordinance <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Observations: <br /> <br />On January 16, 1991, the City received an application to amend the zoning boundaries between the <br />residential and business districts in the proposed plat of Faye 2nd Addition. <br /> <br />On March 5, 1991, the Planning and Zoning Commission conducted a public hearing and <br />recommended Council approval of the rezoning contingent upon the plat being recorded. There <br />was an error in the public hearing notice that was published. The hearing notice indicated that the <br />commercial zoning on the property consisted of B-3 Highway Business; the commercial zoning on <br />the property currently consists of a combination of B-3 Highway Business and B-1 Business. The <br />City Attorney has given an opinion that the error was not significant enough to require another <br />public hearing as the commercial zoning will remain to be a combination of B-3 and B-I; only the <br />boundary between the commercial and residential zoning is being amended. However, Council <br />should take action to amend the proposed f'mdings of fact to reflect that there currently exists a <br />combination of B-1 and B-3 commercial zoning on the property. <br /> <br />Recommendation: <br /> <br />The Planning and Zoning Commission and City Staff recommend approval of the request to amend <br />the zoning district boundaries in the proposed plat of Faye Addition contingent upon the plat <br />receiving final plat approval and being recorded at the Count3,. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Resolution #91-04-~ adopting Findings of Fact # . relating to Faye <br />Construction's request for a rezoning of the business and residential areas in the proposed <br />plat of Faye 2nd Addition. <br /> <br />Motion to: <br />Inn-oduce Ordinance g91-__ to amend the business and residential zoning boundaries in <br />the proposed plat of Faye 2nd Addition. <br /> <br />I <br /> <br />Review Checklist: <br />CC: 4/23/91 <br /> <br />Zoning Administrator <br />Planning and Zoning Commission <br /> <br />I <br /> <br /> <br />
