SCHEDULE A CITY OF RAMSEY ANOKA COUNTY, MINNESOTA ASSESSMEN~r AGREEMENT - CEDAR HILLS THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a municipal corporation of the State of Minnesota (the "City"), and M. G. ASTELFORD COMPANY, a Minnesota partnership, whose address is (the "Developer"). WITNESSETH: WHEREAS, the DEVELOPER is the fee owner of the following described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: The northeast quarter of the southwest quarter of Section 26, Township 32, Range 25, and the north 504.50 feet of the southeast quarter of the southwest quarter of Section 26, Township 32, Range 25, Anoka County, Minnesota (the "Subject Property"); and WHEREAS, on , pursuant to Resolution No. , the City has approved the final plat of a portion of the Subject Property which plat is known as Cedar Hills (the "Plat") which approval is contingent on certain requirements, including Developer and City entering into a Development Agreement (the "Agreement"); and WHEREAS, the Agreement requires that Developer enter into this Assessment Agreement relating to certain Public Improvements, as defined in the Agreement, which City wilt be installing for the benefit of the Plat. NOW, THEREFORE, in consideration of the mutual covenants and obligations of the City and the Developer, each party does hereby represent, covenant and agree with the other as follows: ARTICLE I REPRESENTATIONS AND UNDERTAKINGS The Developer makes the following representations and undertaking~: a. The Developer has the legal authority and power to enter into this Assessment Agreement. b. The Developer will comply with and fulfill each of its obligations as required by the Agreement.
