i I I I I I I I I I I I I I I I I i i SCHEDULE A CITY OF RAMSEY ANOKA COUNTY, MINNESOTA ASSESSMENT AGREEMENT - WINDEMERE WOODS THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a municipal corporation of the State of Minnesota (the "City"), and SWEET LITTLE DEAL, a Minnesota corporation, whose address is P.O. Box 989, Anoka, Minnesota 55303, and ALLEN L. KOENIG and ALICE M. KOENIG, husband and wife, whose address is 14290 Sunfish Lake Boulevard, Ramsey, Minnesota 55303 (collectively referred to as "Developer"). WITNESSETH: WHEREAS, the DEVELOPER is the fee owner of the following described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legal}y described as follows: The Southwest Quarter of the Southeast Quarter of Section 26, Township 32, l{ange 25, Anoka County, Minnesota. Except the South 20(] feet of the East 200 feet and the South 250 feet of the West 250 feet thereof (the "Subject Property"); and WHEREAS, on , pursuant to Resolution No. , the City has approved the final plat of a portion of the Subject Property which plat is known as Windemere Woods (the "Plat") which approval is contingent on certain requirements, including Developer and City entering into a Development Agreement (the "Agreement"); and WHEKEAS, the Agreement requires that Developer enter into this Assessment Agreement relating to certain Public Improvements, as defined in the Agreement, which City will be installing for the benefit of the Plat. NOW, THEREFORE, in consideration of obligations of the City and the Developer, each covenant and agree with the other as follows: the mutual covenants and party does hereby represent, ARTICLE I KEPKESENTATIONS AND UNDERTAKINGS The Developer makes the following representations and undertakings: a. The Developer has the legal authority and power to enter into this Assessment Agreement. b. The Developer will comply with and fulfill each of its obligations as required by the Agreement. A-1
