i <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />i <br /> <br /> SCHEDULE A <br /> <br /> CITY OF RAMSEY <br /> <br /> ANOKA COUNTY, MINNESOTA <br /> <br />ASSESSMENT AGREEMENT - WINDEMERE WOODS <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a municipal corporation of the State of Minnesota (the "City"), and <br />SWEET LITTLE DEAL, a Minnesota corporation, whose address is P.O. Box 989, <br />Anoka, Minnesota 55303, and ALLEN L. KOENIG and ALICE M. KOENIG, husband <br />and wife, whose address is 14290 Sunfish Lake Boulevard, Ramsey, Minnesota 55303 <br />(collectively referred to as "Developer"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described <br />property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, <br />and legal}y described as follows: <br /> <br />The Southwest Quarter of the Southeast Quarter of Section 26, Township 32, <br />l{ange 25, Anoka County, Minnesota. Except the South 20(] feet of the East <br />200 feet and the South 250 feet of the West 250 feet thereof <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on , pursuant to Resolution No. , the <br />City has approved the final plat of a portion of the Subject Property which plat is <br />known as Windemere Woods (the "Plat") which approval is contingent on certain <br />requirements, including Developer and City entering into a Development <br />Agreement (the "Agreement"); and <br /> <br /> WHEKEAS, the Agreement requires that Developer enter into this <br />Assessment Agreement relating to certain Public Improvements, as defined in the <br />Agreement, which City will be installing for the benefit of the Plat. <br /> <br /> NOW, THEREFORE, in consideration of <br />obligations of the City and the Developer, each <br />covenant and agree with the other as follows: <br /> <br />the mutual covenants and <br />party does hereby represent, <br /> <br /> ARTICLE I <br /> <br /> KEPKESENTATIONS AND UNDERTAKINGS <br /> <br />The Developer makes the following representations and undertakings: <br /> <br />a. The Developer has the legal authority and power to enter into this <br /> Assessment Agreement. <br /> <br />b. The Developer will comply with and fulfill each of its obligations as <br /> required by the Agreement. <br /> <br />A-1 <br /> <br /> <br />
