DEVELOPMENT.AGREEMENT- CEDAR HILLS <br /> <br /> WHEREAS, Developer has submitted a petition requesting the extension of <br />sewer and water to the Sub}ect Property; and <br /> <br /> WHEREAS, the Developer has submitted a petition to the City requesting <br />the construction of Public Improvements, as hereinafter defined, which consist of <br />certain Stage I Improvements related to the Plat; and <br /> <br /> WHEREAS, pursuant to said petition the City ordered the preparation of a <br />feasibility report prepared by its City Engineer relating to the proposed Public <br />Improvements; and <br /> <br /> WHEREAS, the City conducted an Improvement Public Hearing on the <br />Public Improvements on June 12, 1990; and <br /> <br /> WHEREAS, subsequent to the June 12, 1990 hearing the City ordered the <br />Public Improvements to be constructed and directed the City Engineer to prepare <br />plans and specifications and advertise for bids and will award a contract for the <br />construction of the Public Improvements to the lowest responsible bidder; and <br /> <br /> WHEREAS, no expenditure of City funds, including the ordering of plans and <br />specifications, will be made until the Developer complies with City Code financial <br />guaranty requirements; <br /> <br />NOW, THEREFORE, the City and Developer agree as follows: <br /> <br />DEFINITIONS <br /> <br />1. Definitions. In this Agreement, the following terms have the following <br /> respective meaning unless the context clearly requires otherwise: <br /> <br /> (a) Agreement: This Agreement, as the same may be from time to time <br />modified, amended, or supplemented. <br /> <br /> (b) Assessment Agreement: The agreement to be entered between the <br />City and Developer, which is attached hereto as Schedule A. <br /> <br /> (c) Authorizing Resolution: The resolution of the City, substantially in <br />the form of the attached Schedule B to be adopted by the City to authorize the <br />issuance of the Note. <br /> <br /> (d) Certificate of Occuloancv: A document issued Dy the City's Building <br />Official which authorizes a structure to be used for its intended purposes. <br /> <br /> (e) City: The City of Ramsey, Anoka County, Minnesota. <br /> <br /> (f) County: Anoka County, Minnesota. <br /> <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I, <br />I <br /> <br /> <br />
