Councilmember its adoption: , introduced the following resolution and moved for RESOLUTION ~g91-06- _ _, RESOLUTION VACATING THE NORTH 320 FEET OF OUTLOT B, COUNTRYSIDE ESTATES. WHEREAS, Outlot B, Countryside Estates was d~dioated to the public as a park pursuant to a 1972 plat which was accepted and approved by the then Ramsey Township; and WHEREAS, through a series of errors by the developer of the plat, the City of Ramsey, Anoka County, a builder, and a title company, a house was permitted to be constructed on the North 320 feet of Outtot B, Countryside Estates; and WHEREAS, it is not economically feasible, perlmps not legally feasible, to require that the house be removed from said North 320 feet of Ouflot B; and WHEREAS, the City's Planning & Zoning Commission has recommended the vacation of the North 320 feet of said Outlot B; and WHEREAS, the City Council finds that it appears in the interest of the public to vacate the North 320 feet of Outlot B, Countryside Estates; and WHEREAS, the City's Planning & Zoning Commission conducted a public hearing on the proposed vacation on June 3, 1991, as required by MSA g412.851, which notice of public hearing was properly published and written notice properly given. WHEREAS, the City's Charter Section 12.06 requires that public grounds may be vacated only by ordinance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: To introduce an Ordinance which shall vacate the North 320 feet of Out. tot B, Countryside Estates, Anoka County, Minnesota. The motion for the adoption of the foregoing resolution was duly seconded by Councitmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the 25th day of June, t99I.
