I <br /> <br />I <br /> <br /> ARTICLE 1 <br />REPRESENTATIONS AND UNDERTAKINGS <br /> <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />o <br /> <br />The Developer makes the following representations and undertakings: <br /> <br />The Developer has the legal authority and power to enter into this Assessment <br />Agreement. <br /> <br />bo <br /> <br />The Developer will comply with and fulfill each of its obligations as required by the <br />Agreement. <br /> <br />The City makes the following representations and undertakings: <br /> <br />a. The City is authorized by law to enter into this Assessment Agreement. <br /> <br />The City will comply with and fulfill each of its obligations as required by the <br />Agreement. <br /> <br />The City will construct the Public Improvements under the terms and conditions of <br />the Agreement, and will follow the City's normal inspection and acceptance <br />practices, pay its contractor for the work and will not permit liens to be filed against <br />the Plat. <br /> <br />ARTICLE II <br />WAIVER <br /> <br />Developer waives all fight to public hearing and other statutory, City Charter and City <br />Ordinance fights, and specifically all fights to appeal, all as granted to a property owner <br />under Chapter 429 of Minn. Statutes, Chapter 8 of the City Charter and City Ordinance <br />84-8 respectively, as said rights granted therein relate to those Public Improvements <br />described in the Agreement. <br /> <br />ARTICLE III <br />IMPROVEMENTS <br /> <br />The City will construct the Public Improvements described in paragraph 4 of the Agreement <br />pursuant to its regular methods of making improvements. The Developer agrees that <br />special assessments for said Public Improvements may be levied by the City, without <br />Developer's objection, after consmaction is commenced, and that the City may recover its <br />costs and expenses (including legal, fiscal and engineering). The special assessments will <br />be payable in equal installments together with interest thereon as determined by the City <br />over a period of five (5) years and further upon those terms as required in the Agreement. <br /> <br /> ARTICLE IV <br />ESTIMATED CONSTRUCTION COST AND ESTIMATED ASSESSMENTS <br /> <br />The estimated construction cost of the Improvements, as est/mated by the City Engineer, is <br />as follows: <br /> <br />Trunks (Sanitary and Water) Standard Trunk Charge* <br />Sewer Lateral, Water Lateral, Stormwater, Streets and Trails, <br />Park, Overhead** <br />TOTAL <br /> <br /> $24,426 <br /> <br /> $130.230 <br />$154,656 <br /> <br />I <br />I <br /> <br />Assessment Agreement - <br /> A.2. <br /> <br />Chestnut Pond <br /> <br />145 <br /> <br /> <br />
