I I ARTICLE 1 REPRESENTATIONS AND UNDERTAKINGS I I I I I I I I I I I I I I o The Developer makes the following representations and undertakings: The Developer has the legal authority and power to enter into this Assessment Agreement. bo The Developer will comply with and fulfill each of its obligations as required by the Agreement. The City makes the following representations and undertakings: a. The City is authorized by law to enter into this Assessment Agreement. The City will comply with and fulfill each of its obligations as required by the Agreement. The City will construct the Public Improvements under the terms and conditions of the Agreement, and will follow the City's normal inspection and acceptance practices, pay its contractor for the work and will not permit liens to be filed against the Plat. ARTICLE II WAIVER Developer waives all fight to public hearing and other statutory, City Charter and City Ordinance fights, and specifically all fights to appeal, all as granted to a property owner under Chapter 429 of Minn. Statutes, Chapter 8 of the City Charter and City Ordinance 84-8 respectively, as said rights granted therein relate to those Public Improvements described in the Agreement. ARTICLE III IMPROVEMENTS The City will construct the Public Improvements described in paragraph 4 of the Agreement pursuant to its regular methods of making improvements. The Developer agrees that special assessments for said Public Improvements may be levied by the City, without Developer's objection, after consmaction is commenced, and that the City may recover its costs and expenses (including legal, fiscal and engineering). The special assessments will be payable in equal installments together with interest thereon as determined by the City over a period of five (5) years and further upon those terms as required in the Agreement. ARTICLE IV ESTIMATED CONSTRUCTION COST AND ESTIMATED ASSESSMENTS The estimated construction cost of the Improvements, as est/mated by the City Engineer, is as follows: Trunks (Sanitary and Water) Standard Trunk Charge* Sewer Lateral, Water Lateral, Stormwater, Streets and Trails, Park, Overhead** TOTAL $24,426 $130.230 $154,656 I I Assessment Agreement - A.2.
