Councilmember DeLuca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g90-12-373 <br /> <br />RESOLUTION AUTHORIZING THE CITY OF RAMSEY TO ENTER INTO AN <br />EASEMENT ACQUISITION AND ASSESSMENT AGREEMENT FOR THE <br />MCKINLEY STREET EXTENSION <br /> <br /> WHEREAS, the City Council of the City of Ramsey has constructed a sanitary sewer <br />trunk along the proposed McKinley Street N.W. extension as Improvement Project #87-19; and <br /> <br /> WHEREAS, City Staff has negotiated a proposed agreement for the acquisition of an <br />80' wide right-of-way for the McKinley Street N.W. extension as follows: <br /> <br />1) <br /> <br />The City at its expense will construct a street and storm sewer system along <br />the right-of-way using tax increment financing. <br /> <br />2) The City at its expense will install watermain prior to conslructing the street. <br /> <br />3) <br /> <br />The landowners will not be assessed for the street consmaction since it will <br />be paid for by tax increment financing. <br /> <br />4) <br /> <br />The cost of trunk watermain or sanitary sewer will not be assessed to <br />benefiting property owners, however, at the time the land is developed, the <br />developers will be required to pay a service availability surcharge (SAS) <br />when connection is made to the utilities. The landowners will be <br />responsible, at their own expense, for the construction of any water and <br />sewer laterals needed for their respective future land development. <br /> <br />5) <br /> <br />In return for the City's commitments contained in items one and two above, <br />the landowners will convey to the City marketable tire to the necessary 80' <br />right-of-way. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby authorizes the City Attorney to prepare easement acquisition <br />and assessment agreements between the City and the landowners (Mr. Spohn and Ramsey <br />67 Industrial Park) based upon the terms stated above. <br /> <br />2) <br /> <br />That the City Council hereby authorizes the Mayor and City Administrator to sign on behalf <br />of the City and the easement acquisition and assessment agreements with Mr. Spohn and <br />the Ramsey 67 Industrial Park parmership. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Pearson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Reimann <br />Councilrnember DeLuca <br />Couneilmember Pearson <br />Councilmember Cich <br />Councilmember Peterson <br /> <br /> <br />
