Councilmember DeLuca introduced the following resolution and moved for its adoption: RESOLUTION g90-12-373 RESOLUTION AUTHORIZING THE CITY OF RAMSEY TO ENTER INTO AN EASEMENT ACQUISITION AND ASSESSMENT AGREEMENT FOR THE MCKINLEY STREET EXTENSION WHEREAS, the City Council of the City of Ramsey has constructed a sanitary sewer trunk along the proposed McKinley Street N.W. extension as Improvement Project #87-19; and WHEREAS, City Staff has negotiated a proposed agreement for the acquisition of an 80' wide right-of-way for the McKinley Street N.W. extension as follows: 1) The City at its expense will construct a street and storm sewer system along the right-of-way using tax increment financing. 2) The City at its expense will install watermain prior to conslructing the street. 3) The landowners will not be assessed for the street consmaction since it will be paid for by tax increment financing. 4) The cost of trunk watermain or sanitary sewer will not be assessed to benefiting property owners, however, at the time the land is developed, the developers will be required to pay a service availability surcharge (SAS) when connection is made to the utilities. The landowners will be responsible, at their own expense, for the construction of any water and sewer laterals needed for their respective future land development. 5) In return for the City's commitments contained in items one and two above, the landowners will convey to the City marketable tire to the necessary 80' right-of-way. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes the City Attorney to prepare easement acquisition and assessment agreements between the City and the landowners (Mr. Spohn and Ramsey 67 Industrial Park) based upon the terms stated above. 2) That the City Council hereby authorizes the Mayor and City Administrator to sign on behalf of the City and the easement acquisition and assessment agreements with Mr. Spohn and the Ramsey 67 Industrial Park parmership. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Pearson and upon vote being taken thereon, the following voted in favor thereof: Mayor Reimann Councilrnember DeLuca Couneilmember Pearson Councilmember Cich Councilmember Peterson
