on the Date of Closing, LANDOWNERS will convey to the CITY by quit <br />claim deed the permanent 40 foot wide utility easement. <br /> <br /> 2. Payment to Landowners: As consideration for the property <br />rights granted to the CITY in Paragraph 1 above, the CITY agrees <br />that there will be no special assessments to LANDOWNERS' real <br />property, nor any other type of payment required in exchange for <br />the benefit LANDOWNERS~ real property receives from the McKinley <br />Street construction and the storm sewer system serving said street. <br /> <br /> In addition to the above, the CITY on the date of closing will <br />pay $450.00 to L;tNDOWNERS representing the loss of a portion of <br />their rye crop as result of the construction damages during the <br />summer of 1988. <br /> <br /> 3. Riqht of Entry. LANDOWNER does hereby grant to the CITY, <br />its contractors and assigns the right to enter upon the McKinley <br />Street right-of-way and the permanent utility easement for the <br />purpose of constructing the storm sewer, watermains, pipes and <br /> <br /> and street, immediately upon <br /> <br />appurtenances, other utilities, <br />execution of this Agreement. <br /> <br /> II. <br /> <br />IMPROVEMENTS TO BE CONSTRUCTED BY THE CITY <br /> <br />~ecific Improvements: <br /> <br />Construction of McKinley Street Extension. The CITY will <br />cause to be constructed a street to conform to existing <br />Municipal State Aid (MSA) specifications including <br />concrete curb and gutter on the McKinley Street Right- <br />of-Way. The street shall be known as McKinley Street and <br />will be constructed following installation of the <br />utilities and no later than December 31,1991.
