One of the terms of that permit <br />specified that the event would be only permitted on the Saturday and Sunday of the weekend <br />preceding Labor Day weekend and on Saturday, Sunday and Monday of Labor Day weekend. In <br />1989, Mr. Delaney revised the dates of the Game Fair event to the second and third weekends in <br />August. Technically, Mr. Delaney's conditional use permit would require an amendment. <br />Amending a conditional use permit requires reapplication, another public hearing by the Planning <br />and Zoning Commission and a decision from City Council. However, in this instance, I believe <br />the intent of the original permit issued was to limit the event to two consecutive weekends per year <br />rather than specifying the dates on which the event could be held. On that basis, I am pursuing an <br />administrative amendment to the conditional use permit. To accomplish that, I propose to <br />document the amendment in Mr. Delaney's case file if I receive no opposition from City Council <br />regarding the subject matter of this memo and it is accepted in the Consent Agenda of the July 23, <br />1991 City Council agenda. If there is Council opposition, I will inform Mr. Delaney that it will be <br />necessary for him to apply for a Conditional Use Permit Amendment. <br /> <br /> <br />
