1 <br /> <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> <br />CASE <br /> <br />REQUEST TO <br /> <br />CONSIDER AMENDING TERMS OF CONDITIONAL USE <br /> PERMIT; CASE OF JAMES MONSON <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, on December 18, 1990 the City of Ramsey issued a conditional use permit to <br />Mr. James Monson to construct an amateur radio tower on his property at 15705 Traprock Street <br />N.W. In response to the concerns of the area residents, Mr. Monson volunteered to plant a tree <br />screen to obscure visibility of the tower. The conditional use permit approved for issuance <br />required Mr. Monson to plant coniferous trees every 15-20 feet along his front property line by the <br />fall of 1991. <br /> <br />Observations: <br /> <br />On May 30, 1991, I received a petition from a couple of the area residents requesting that the City <br />reconsider the terms of the conditional use permit issued to James Monson for the amateur radio <br />tower. The term that the area residents raised for reconsideration is that which requires Mr. <br />Monson to plant a coniferous m every 15-20 feet along the front property line. The residents are <br />now asking that the conditional use permit be amended to require that the placement of trees for <br />screening purposes be determined following the construction of the tower versus arbitrarily <br />planting a wall of trees along the front property line only. <br /> <br />On July 2, 1991, the Ramsey Planning and Zoning Commission conducted a public hearing <br />regarding the request to amend the terms of the conditional use permit issued to James Monson. <br />There were no citizens present expressing opposition to amending the conditional use permit. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map. <br />Petition received by the City on May 30, 1991. <br />Findings of fact adopted on December 18, 1990. <br />Conditional use permit approved on December 18, 1990. <br />Proposed amended conditional use permit <br /> <br />Recommendation: <br /> <br />The Planning and Zoning Commission recommended that City Council amend the conditional use <br />permit to require that the location of the tree plantings for screening purposes be determined <br />following the construction of the radio tower and be subject to the approval of the City Engineer. <br /> <br />Council Action: <br /> <br />Motion to: <br />Approve/deny the request to amend the conditional use permit issued to James Monson at <br />15705 Traprock Street N.W. for an amateur radio tower. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />Zoning Administrator <br /> <br />CC: 7~3/91 <br /> <br />3'7 <br /> <br /> <br />
