there would not be the ability to also have a special assessment against the same properties. <br />Should there already be an assessment, the franchise fee would be rebated. <br />Mayor Strommen asked if the Council can use the franchise fee to fund half of the need with <br />assessments funding a different part of the project. <br />City Attorney Langel stated his understanding it is not getting to a project -by- project basis. If <br />there is already an assessment going on and the City approves franchise fees, to the extent a <br />resident pays assessments, they would not pay franchise fees. <br />City Administrator Ulrich explained if it is a new project initiated during the term in which <br />franchise fees are in place, the City could not mix /match. It has to be one or the other. <br />City, Attorney Langel agreed and stated there would no longer be assessments if the franchise fee <br />is approved. <br />City Administrator Ulrich agreed the discussion has been that it would be one or the other, not <br />both. <br />Mayor Strommen stated if the franchise fee is only $3, and $8 is needed, then there will be parts <br />of the project cost that will not be covered. <br />City Administrator Ulrich stated if there are other projects with legitimate assessments, that <br />would have nothing to do with the franchise fee. <br />Mayor Strommen stated she is asking about the ability for an argument, should there be a project <br />funding shortfall because the franchise fee cannot cover all of the costs, can a portion of the <br />project costs be assessed. She asked if the language should indicate: "for road street <br />maintenance projects as defined above." Mayor Strommen suggested the language be refined so <br />the intent is clearly stated and understood. <br />Councilmember LeTourneau stated the Mayor is asking for language to be tightened up so it is <br />clear that if franchise fees are in place, there will be no special assessments. <br />Councilmember Riley asked if new roads will be assessed. <br />Councilmember Kuzma stated it was his understanding that if there are franchise fees, there will <br />be no assessments. <br />Mayor Strommen stated the franchise fees are for road maintenance projects and she was asking <br />about new street projects. She stated if all agree the intent is that you cannot pool two options, <br />staff can refine the language. <br />Councilmember Johns asked if a road project to pave a gravel road would be eligible for special <br />assessments or some other form of funding. <br />City Council Work Session / January 14, 2014 <br />Page 3 of 9 <br />
