Mayor Strommen asked if this language captures the Council's intent, given the language <br />tweaking that has been discussed. <br />No objections or comments were expressed about the language with the understanding it is a <br />draft and will be referred to the Charter Commission. <br />Councilmember Johns asked if the intention is that franchise fees will be permanent and only <br />used for street maintenance. She stated she hoped that eventually it could be incorporated into <br />the levy system. However, the language restriction appears to make it permanent. <br />Mayor Strommen stated the language can probably accomplish that since it indicates if franchise <br />fee revenue is collected, it has to be used for street maintenance <br />Councilmember Johns asked about the ability for future Council's to use franchise funding for <br />another purpose that may come to light. <br />Mayor Strommen stated at this point, the Council has indicated franchise fees would be limited <br />to this use and in the future if that changes, there will have to be another conversation with the <br />Charter Commission and residents. <br />Councilmember LeTourneau stated the language does not restrict the Council from discontinuing <br />franchise fees if it is found to no longer be needed or no longer desirable. <br />City Attorney Ulrich stated that is correct. <br />Councilmember LeTourneau stated the language also does not restrict the Council from lowering <br />the amount of franchise fees. <br />Mayor Strommen stated that is correct; however, it does limit the Council from adding special <br />assessments if it is found the franchise fee is not sufficient. <br />Councilmember Kuzma stated the language is getting closer and at the end of the day, the road <br />issue remains and that needs to be dealt with. <br />Mayor Strommen agreed that is the end goal that all support and the discussion is for reasonable <br />limitations on a franchise fee so there is assurance, if this option moves forward. <br />It was noted this item is on tonight's Council agenda. <br />2.03: Update on LRRWMO JPA Amendment Proposal to Allow Weighted Voting for <br />Capital Improvement Projects <br />Mayor Strommen recused herself from this discussion as she works for the Board of Water and <br />Soil Resources, which has an oversight role of the Lower Rum River Water Management <br />Organization (LRRWMO). <br />City Council Work Session / January 14, 2014 <br />Page 6 of 9 <br />
