The DEVELOPER agrees that this <br />Development Agreement shall be recorded in the office of the Anoka County <br />Recorder and agrees that the terms and provisions of this Agreement shall be a <br />covenant on any and ali deeds relative to the property included in the Plat. <br /> <br /> II. <br />STAGE II IMPROVEMENTS AND FINANCIAL GUARANTEES: <br /> <br />Street Cleaning. After the street surfacing is installed, the DEVELOPER shall <br />clear any soil, earth, or debris from the streets and from the lots within the Plat <br />resulting from construction on the Subject Property by the DEVELOPER or its <br />successors and assigns. The DEVELOPER, its successors or assigns agree to <br />complete all finished grading, swales, ditches to the satisfaction of the City <br />Engineer and to maintain said, grading, swales and ditches until certificates of <br />occupancy are issued for all lots within the Plat. During this period the <br />DEVELOPER shall prevent erosion by wind and water to the satisfaction of the <br />City Engineer. <br /> <br />Street/Traffic Signs, Street Lights and Seal Coating. The CITY will <br />install in the Plat, as Stage II Improvements street/traffic signs, street cleaning, <br />street lights and street seal coating. The DEVELOPER will pay to the CITY an <br />amount equal to 100% of the City Engineer's estimated construction cost of the <br />items prior to recording of the final Plat. The total cost of these items is Three <br />Thousand Four Hundred and Fifty Dollars and 00/100 ($3,450.00). <br /> <br />Seal Coating $1,750.00 <br />Street Signs $ 100.00 <br />Street Lights $1,200.00 <br />Street Cleaning $ 300.00 <br />Traffic Signs $ 100.00 <br /> <br />Total: $3,450. O0 <br /> <br />Hard Surfaced Driveways and Sodding. Hard surfaced driveways and <br />sodded boulevards are a requirement for each lot in the Plat. Said improvements <br />shall be installed by the building permit applicant or the homeowner at the time the <br />Certificate of Occupancy is issued. In the event these items are not completed at the <br />time the Certificate of Occupancy is issued, the City Building Official shall <br />prescribe a time frame for completion of these required improvements. In the event <br />said improvements are not installed within that prescribed time frame, the <br />DEVELOPER, on behalf of all subsequent owners of lots within the Plat, agrees <br />that the CITY may install said improvements on any lot(s) and specially assess its <br />cost therefore against each said lot. The DEVELOPER hereby waives all fight to a <br />public hearing and other statutory rights or City Charter fights granted a property <br />owner relating to special assessments, including the right to appeal the special <br />assessment for installation of the improvements described in this paragraph.
