I <br /> <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> CASE #7 <br /> REPORT ON WASTE MANAGEMENT OF MINNESOTA, INC. <br /> TIPPING FEE DISPARITY <br /> By: Ryan Schroeder, City Administrator <br /> <br />Background: <br /> <br />As City Council will recall, some time ago, the City of Ramsey, the City of Anoka and Waste <br />Management of Minnesota, Inc. entered into agreements which resulted in receipt of revenues to <br />the City of Ramsey from Waste Management of Minnesota, Inc. in return for giving up property <br />rights to the landfill some years back. <br /> <br />For the year 1990, Ramsey received $137,164.00 in payments pursuant to this agreement. <br />Between January 1991 and May 1991, Ramsey received $46,982.00 from this payment. <br />Attached is a table which details these payments on a monthly basis and their revenues from which <br />these payments are derived. You will note in a column labeled "Less Part E, Item 3, Anoka <br />County License" that Waste Management has, since January 1990, determined that $818,265.00 <br />of revenues are not encumbered by their obligation to make a pementage payment to the City of <br />Ramsey. This has resulted in a reduction over the year and a half period of time of $81,827.00 to <br />the City of Ramsey. A similar reduction in payment has been received by the City of Anoka. <br /> <br />On Tuesday, August 13, 1991 the City Administrator and City Attorney are meeting with the City <br />Manager and the City Attorney from the City of Anoka in order to determine whether these <br />reductions in payments are appropriate. <br /> <br />The rationale for this item being on the agenda is that it is the intent of the City Administrator to <br />determine if litigation is appropriate in order to attempt to recover some or all of these reductions in <br />payments. <br /> <br />Due to scheduling conflicts, we have been unable to meet prior to this August 13 meeting. It is not <br />contemplated that additional written material will be presented to City Council at the August 13 <br />meeting, but it may be appropriate to close the meeting should we determine that the net-end result <br />of the earlier meeting of the day may result in pending litigation. <br /> <br />Recommendation: <br /> <br />Any recommendation will be presented at the Council meeting. <br /> <br />Council Action: <br /> <br />Based upon discussion. <br /> <br />Review Checklist: <br /> <br />City Adrninisa'ator <br />Finance Officer <br />City Attomey <br /> <br />CC: 08/13/91 <br /> <br /> <br />
