'1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE <br /> <br />FOR AN <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />OUTSIDE DISPLAY/SALES AREA; CASE OF JIM PROVINZINO <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Jim Provinzino is proposing to establish a motor vehicle sales lot at 6304 Hwy. #10 N.W. <br />The subject property is approximately 1/2 acre in size and is zoned B-3 Highway Business. Motor <br />vehicle sales is a permitted use in the B-3 Business District. However, according to City Code, a <br />conditional use permit is required if a permitted use in the B-3 District includes an outside <br />display/sales area. Mr. Provinzino's site plan proposed to have a maximum of 28 vehicles in the <br />outside display area. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan (2 sheets) <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />On August 6, 1991, the Planning and Zoning Commission conducted a public hearing and <br />recommended approval of Mr. Provinzino's request for a conditional use permit for an outside <br />display area. The Commission also recommended that the conditional use permit limit the number <br />of cars permitted to be displayed on the property to a maximum of 23, establish a 10 foot setback <br />from the front property line for the display area, and that a 20 foot fire lane be maintained on the <br />site. At the suggestion of the Planning and Zoning Commission, Mr. Provinzino is also willing to <br />locate the customer parking at the front of the property, rather than to the rear as shown in his site <br />plan. <br /> <br />It has also come to Staff's attention that the two year time frame for connection to municipal <br />services has lapsed. Mr. Provinzino has indicated a willingness to connect and Project Manager <br />Gromberg will be following up on this matter. <br /> <br />Recommendation: <br /> <br />The Planning and Zoning Commission recommends approval of Mr. Provinzino's request for a <br />conditional use permit. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Adopt Resolution g01-08- adopting Findings of Fact # relating to Jim Provinzino's <br />request for a conditional use permit for an outside display/sales area. <br /> <br />Motion to: <br />Approve/deny Mr. Jim Provinzino's request and Adopt Resolution #91-08-~ <br />establishing the terms of a conditional use permit for an outside display/sales area at 6304 <br />Hwy. #10 N.W. <br /> <br />Review Checklist: <br />CC: 8/27/91 <br /> <br />City Administrator <br />Zoning Administrator <br /> <br /> <br />
