SYBRANT <br /> By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />Mr. Richard J. Sybrant, Developer of North Forty 3rd Addition, has a buyer for Lot 2, Block 2 of <br />the above mentioned subdivision. This subdivision has a natural low area and a considerable <br />drainage easement encompassing not only the low area but the lands immediately west of the <br />depression. The potential home owner wishes to construct his home in an area partially <br />encompassed by the drainage easement dedicated on the plat. Mr. Sybrant wishes to vacate a <br />portion of the drainage easement as illustrated on the attached survey. <br /> <br />The drainage easement had anticipated receiving water from a considerable area. Actual <br />construction, however, diverted a substantial portion of the drainage to another ponding easement <br />located south of 155th Lane N.W. As a result, there is basis for considering a reduction in the area <br />of the drainage easement. <br /> <br />Recommendation: <br /> <br />Statutes require vacation of all easement to have a public hearing. I would recommend that this <br />vacation request be forwarded to the Planning and Zoning Commission for a public hearing and <br />recommendation. <br /> <br />Council Action: <br /> <br />Motion to forward the partial drainage easement vacation, case of Richard J.
