Schroeder, City Administrator <br /> <br />Background: <br /> <br />As Council is aware, Staff is conducting several activities relating to the Wood Pond <br />Projects in order to ensure placement of the utilities: <br /> <br />1) <br />2) <br /> <br />3) <br /> <br />4) <br /> <br />Hakanson Anderson Associates, Inc. has been designing the project itself. <br />We have been gaining appraisals in order to determine value of the parcels we are <br />taking. <br />Two of the three developers have inititated rough grading on their first phase <br />roadway construction. <br />We have filed with the court as of September 24, 1991 the petition for quick take. <br />We expect to have the public purpose hearing for the quick take on November 8, <br />1991 and expect to have an award on December 23, 1991. We also expect to have <br />the appraisals for value by about mid-October. Because of the proposed construction <br />schedule, we will not be able to enter into purchase agreements or receive the benefit <br />of the quick take prior to when the consulting engineer would like to have access to <br />the easement properties. Therefore, we have had to draft fight-of-entry agreements <br />to which we expect the owners of these easement areas to agree. This allows us to <br />utilize the easement areas even though we do not have ownership of them prior to <br />eventual acquisition of the easements. It is fairly typical, however, that in gaining <br />right-of-entry signatures, that the public agency conducting the taking must make a <br />deposit in the amount of the quick take appraised value. Staff is comfortable with <br />proceeding on the fight-of-entries in this manner, but to date we had not yet asked <br />Council for authority to provide for the appraisal deposits should such be a demand <br />by any of the owners involved. We are at this point uncertain as to whether such a <br />demand should be asserted, however, in the case that this does occur, Staff would <br />appreciate the authority to enter into the requisite agreement. <br /> <br />Council Action: <br /> <br />Motion to authorize Staff to enter into right-of-entry agreements with the owners of property <br />in the Wood Pond developments for purposes of utility easements and further allowing Staff <br />to enter into these agreements compensating the owners up to the amount of the quick take <br />appraisal deposit. <br /> <br />Review Checklist: <br />City Administrator <br /> <br /> <br />
