DENIAL OF APPLICATION FOR ON-SALE LIQUOR LICENSE FOR <br />I JOEL LALLEY, JIMMY B'S AMERICAN CAFE AND LOUNGE <br /> By: Michael Auspos, Chief of Police <br /> <br />Background: <br /> <br />On September 25, 1991 the City received an application from Joel Lalley for an on-sale <br />intoxicating liquor license. He planned to take over the operation at Jimmy B's American Cafe and <br />Lounge. Along with his application was a check for $250.00 for the investigation fee as required <br />by ordinance. On his application, question #17 was answered in the affh'mative. This question <br />deals with whether or not the applicant has ever been convicted of a liquor law violation. <br /> <br />Observations: <br /> <br />I <br />i <br />I <br /> <br />I received from Carver County, at my request, a copy of the Plea and Sentencing Record regarding <br />the above referenced violation. It does show a conviction for a gross misdemeanor charge in <br />1989. The ordinance, as well as State law, prohibits the issuance of a license for an on-sale <br />intoxicating liquor license if, in the preceding five (5) years, the applicant has had a conviction of <br />any liquor-related statute or ordinance. I have communicated this information to Mr. Lalley and he <br />requested that this case be placed on the October 22, 1991 agenda so that he can attend.
