DENIAL OF APPLICATION FOR ON-SALE LIQUOR LICENSE FOR
I JOEL LALLEY, JIMMY B'S AMERICAN CAFE AND LOUNGE
By: Michael Auspos, Chief of Police

Background:

On September 25, 1991 the City received an application from Joel Lalley for an on-sale
intoxicating liquor license. He planned to take over the operation at Jimmy B's American Cafe and
Lounge. Along with his application was a check for $250.00 for the investigation fee as required
by ordinance. On his application, question #17 was answered in the affh'mative. This question
deals with whether or not the applicant has ever been convicted of a liquor law violation.

Observations:

I
i
I

I received from Carver County, at my request, a copy of the Plea and Sentencing Record regarding
the above referenced violation. It does show a conviction for a gross misdemeanor charge in
1989. The ordinance, as well as State law, prohibits the issuance of a license for an on-sale
intoxicating liquor license if, in the preceding five (5) years, the applicant has had a conviction of
any liquor-related statute or ordinance. I have communicated this information to Mr. Lalley and he
requested that this case be placed on the October 22, 1991 agenda so that he can attend. He
indicated he would have his attorney contact City Attorney Goodrich prior to the Council meeting.

Recommendation:

Staff recommends that Council deny the application by Mr. Lalley for an on-sale intoxicating liquor
license based on the above observations.

I

Council Action:

Motion to deny the application by Mr. Joel Lalley for an on-sale intoxicating liquor license.

I

I

I

I
I

Review Checklist:

Police Chief
City Adminislrator
City Auomey
Finance Officer

I

CC: 10/22/91

!

I
