CASE <br /> <br />LAWSUIT AGAINST WASTE MANAGEMENT OF MINNESOTA, INC. <br /> By: Ryan R. Schroeder, City Administrator <br /> <br />Background: <br /> <br />As you are aware, recently the City Council provided for a fund, with $5,000.00 designated in the <br />fund, in order to serve a summons and complaint jointly with the City of Anoka against Waste <br />Management of Minnesota, Inc. for an alleged "skimming of revenues" by Waste Management <br />from our landfill revenues. Enclosed for your review is this summons and complaint. <br /> <br />Recently Mr. Gedde, representing the City of Anoka, and Mr. Goodrich, representing the City of <br />Ramsey, met with representatives of Waste Management of Minnesota, Inc. to discuss the <br />summons and complaint. Mr. Goodrich will present, verbally, the results of that discussion. <br />However, at this point, I just want to list the issues that seem to bear some relationship to this <br />lawsuit. <br /> <br />1) <br />2) <br />3) <br />4) <br /> <br />5) <br />6) <br />7) <br />8) <br /> <br />The vertical expansion and conditional use permit extensions. <br />The conditional use permit for the tire recycling operation. <br />The conditional use permit for the compost operation (which is not currently operating). <br />The development of the ski hill or dedication and development of park land on the north <br />side of the landfill. <br />The 153rd Avenue N.W. easements. <br />The conditional use permit extension for the ban'ow area. <br />The methane pipeline. <br />The hydro-carbon facility which is only indirectly related but for which you have received a <br />memorandum from me recently. <br /> <br />Recommendation: <br /> <br />To discuss each of those issues listed above as they relate to the summons and complaint and to <br />provide Mr. Goodrich with direction regarding that lawsuit. <br /> <br />It should also be noted that we have placed the attached request by Waste Management of <br />Minnesota, Inc. on the agenda for the Road and Bridge Committee meeting. <br /> <br />Council Action: <br /> <br />~.
