the use or it becomes void. WMMI has not established the yard waste compost facility and has been notified by City Staff that the CUP expired at 5:00 p.m. on November 15, 1991. Water Treatment Facility: On April 23, 1991, WMMI was granted a CUP to establish and operate a groundwater pumpout and treatment system. The CUP was granted for a term which expires on January 31, 1996. The CUP recognizes that the treatment operation may extend beyond 10 years but does require the permit holder to apply for a new CUP within 120 days prior to the expiration date (1/31/96). This is interpreted to mean that to extend beyond 1/31/96, WMMI would have to make new application and it would be subject to a public hearing. Observations: WMMI is requesting extensions to their CUPs for vertical expansion, grading and excavating the north borrow area, waste tire processing, and temporary office structure. In accordance with the terms of those CUPs, reapplication and public hearings would not be required for extensions. The two contingencies to be considered in the request for extensions are that the established capacity goal for the initial 3 year period in vertical expansion has not been met and that WMMI is not proposing to provide a covered storage area for waste tires. Staff has also proposed that, along with discussions on the CUP's, Council consider finalizing other issues. Included are: 1) 2) 3) dedication and deeding of park land. deeding over right-of-way for 153rd Avenue N.W. deeding over land corollary to the north acreage for park dedication. Recommendations: To approve an initial extension of the conditional use permits to June 30, 1992 upon satisfaction of the above and demonstration of a new PCA application for a grading plan based on reduced capacity goals.
