CASE ABATEMENT OF NUISANCE; F & R ENTERPRISES By: Ryan R. Schroeder, City Administrator Background: As Council is aware, the land controlled by F & R Enterprises on Highway #10, west of Puma Street N.W., has contained a blighting condition for some time. Enclosed for your review is Ordinance Section 5.12.01 regarding removal of blight as well a copy of the last correspondence within the file to F & R. This letter requests that they respond as to how they intended to rectify this condition; they have not responded verbally or in written manner. Therefore, given the above, I would request that the City Council schedule a public heating on abatement of this nuisance for January 14, 1992, authorize staff to notify the property owner of the intent of the public hearing and also to authorize proposals from contractors on abatement of this nuisance. It is currently our intent, should Council ratify such action after a public hearing, to enter onto the property, abate the nuisance and to assess this cost back to the property owner. It should also be noted that we currently do not know the extent of the activity nor the subsequent cost to effect this abatement and there is a high potential given the history on this site that there would be significant delay between municipal outlay and receipt of any assessment revenue for abatement of the nuisance. Recommendation: Staff recommends that City Council authorize a public hearing on abatement of the nuisance and direct staff to notify the property owner and receive quotes on abatement of the nuisance. Council Action: Motion to schedule a public hearing on abatement of the nuisance for 7:30 p.m. on Tuesday, January 14, 1992 and direct staff to notify the property owner and receive quotes on abatement of the nuisance.
