CASE REQUEST TO VACATE DEDICATED STREET RIGHT-OF-WAY ACROSS OUTLOTS C AND D OF NORTHFORK P.U.D.; CASE OF NORTH FORK, INC. By: James Gromberg, Project Manager Background: North Fork, Inc. is requesting that the City of Ramsey vacate certain easements that were acquired during the platting process of Northfork P.U.D. The first easement across Outlot D connecting 153rd Avenue N.W. with Highway gl0 was acquired before the City had decided on the exact routing of the future connection of 153rd Avenue N.W. to Highway gl0. The City has now connected 153rd Avenue N.W. to Highway gl0 using a different alignment than the easement that was acquired. State Statute requires that it be found in the public interest to vacate a public street and/or fight-of-way. The vacation being requested is based upon the City no longer having a need for the dedicated alignment for the connection of 153rd Avenue N.W. to Highway gl0. As for the vacation of the road right-of-way across Outlot C connecting Andrie Street N.W. to 164th Avenue N.W. in Woodlawn Estates as indicated in the City Engineer's review letter dated November 20, 1991, the Planning and Zoning Commission did receive additional input from the developer. Attached for your information are the following items: 1) 2) 3) 4) 5) Map showing proposed vacations of road right-of-way Properties notified list for the public hearing City Engineer's review letter to North Fork, Inc. dated November 20, 1991 Copy of the Declaration of Road Easements for Northfork, County Document No. 145957 Copy of the proposed Clerk's Notice of Completion of Vacation Proceedings The Planning and Zoning Commission conducted a public hearing regarding the vacation of these road right-of-ways on December 3, 1991. After receiving input from the members present, the Commission recommended that the City Council vacate the road right-of-ways across Outlots C and D of Northfork P.U.D. City Staff would also recommend that road right-of-ways be vacated, as in the case of Outlot D the City no longer needs access to Highway gl0 from 153rd Avenue N.W. at this point and, according to the City's Thoroughfare Plan, the connection with 164th Avenue N.W. may not be needed in the future; if those streets are connected, they can be acquired through the dedication process when the actual platting takes place, thus allowing for a variety of alignments. Recommendations: It is the recommendation of both City Staff and the Planning and Zoning Commission that the City Council vacate the road easement across Outlot C of Northfork P.U.D. as described in the Clerk's Notice of Proceedings.
