CASE <br /> <br />REQUEST TO VACATE DEDICATED STREET <br />RIGHT-OF-WAY ACROSS OUTLOTS C AND D OF <br />NORTHFORK P.U.D.; CASE OF NORTH FORK, INC. <br />By: James Gromberg, Project Manager <br /> <br />Background: <br /> <br />North Fork, Inc. is requesting that the City of Ramsey vacate certain easements that were acquired <br />during the platting process of Northfork P.U.D. The first easement across Outlot D connecting <br />153rd Avenue N.W. with Highway gl0 was acquired before the City had decided on the exact <br />routing of the future connection of 153rd Avenue N.W. to Highway gl0. The City has now <br />connected 153rd Avenue N.W. to Highway gl0 using a different alignment than the easement that <br />was acquired. State Statute requires that it be found in the public interest to vacate a public street <br />and/or fight-of-way. The vacation being requested is based upon the City no longer having a need <br />for the dedicated alignment for the connection of 153rd Avenue N.W. to Highway gl0. <br /> <br />As for the vacation of the road right-of-way across Outlot C connecting Andrie Street N.W. to <br />164th Avenue N.W. in Woodlawn Estates as indicated in the City Engineer's review letter dated <br />November 20, 1991, the Planning and Zoning Commission did receive additional input from the <br />developer. Attached for your information are the following items: <br /> <br />1) <br />2) <br />3) <br />4) <br /> <br />5) <br /> <br />Map showing proposed vacations of road right-of-way <br />Properties notified list for the public hearing <br />City Engineer's review letter to North Fork, Inc. dated November 20, 1991 <br />Copy of the Declaration of Road Easements for Northfork, County <br />Document No. 145957 <br />Copy of the proposed Clerk's Notice of Completion of Vacation <br />Proceedings <br /> <br />The Planning and Zoning Commission conducted a public hearing regarding the vacation of these <br />road right-of-ways on December 3, 1991. After receiving input from the members present, the <br />Commission recommended that the City Council vacate the road right-of-ways across Outlots C <br />and D of Northfork P.U.D. City Staff would also recommend that road right-of-ways be vacated, <br />as in the case of Outlot D the City no longer needs access to Highway gl0 from 153rd Avenue <br />N.W. at this point and, according to the City's Thoroughfare Plan, the connection with 164th <br />Avenue N.W. may not be needed in the future; if those streets are connected, they can be acquired <br />through the dedication process when the actual platting takes place, thus allowing for a variety of <br />alignments. <br /> <br />Recommendations: <br /> <br />It is the recommendation of both City Staff and the Planning and Zoning Commission that the City <br />Council vacate the road easement across Outlot C of Northfork P.U.D. as described in the Clerk's <br />Notice of Proceedings. <br /> <br />It is the recommendation of both City Staff and the Planning and Zoning Commission that the City <br />Council vacate the road easement across Outlot D of Northfork P.U.D. <br /> <br /> <br />
