CASE <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF COWLES ADDITION, <br /> SUBDIVISION; CASE OF GEORGE COWLES <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />A MINOR <br /> <br />Background: <br /> <br />Mr. George Cowles is requesting final plat approval of a minor subdivision to be named Cowles <br />Addition. The property is located on the north side of Hwy. #10 between Verndale Commercial <br />Park and Ramsey Commercial Park. The property is approximately 3.2 acres in size and currently <br />consists of two unplatted lots and an outlot. The parcels are currently developed with a steel <br />building formerly occupied by The Party House, a second building is currently being used for an <br />auto body repair business, a third structure consists of a private residence and the fourth structure <br />houses C&L Canvas Crafts. As you can see by the enclosed subdivision sketch, most of the <br />structures on the property encroach on setbacks from property lines and both parcels were <br />developed with dual uses. The VFW organization is purchasing the former Party House and Mr. <br />Cowles now finds it necessary to reconfigure the two unplatted lots and outlot into two platted <br />parcels to eliminate some substandard conditions. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Sketch plan <br />City Staff review letter dated November 26, 1991 <br />Proposed resolution <br />Proposed development agreement <br /> <br />Observations: <br /> <br />Lot Width: The total frontage on Hwy. #10 for the properties is such that the minimum lot width <br />of 200 feet for each lot cannot be met. As presently configured, both of the lots are substandard; in <br />the proposed plat, one of the lots will be brought into conformance. <br /> <br />Lot Size: The minimum lot size in the Rural Business District is 1 acre. Lot 1 meets that <br />requirement but Lot 2 is proposed at .967 acres. <br /> <br />Setbacks: Neither of the structures on Lot 2 meet side yard setback requirements from the common <br />property line. The plat proposes to realign the common property line so that all structures will meet <br />setback requirements. The structure on Lot 1 is currently situated on the property line; it is <br />required to have a 20 foot setback from the side property line. The plat will bring Outlot A into the <br />subdivision, thereby providing for a 16 foot side yard setback for the building. <br /> <br />Land Use: City Code does not allow more than one principal use on a property; both of the <br />existing lots have dual uses on them. The subject property is zoned Rural Business and based on <br />the permitted uses in that zone, I am recommending that the auto body repair business and the <br />private residence be treated as non-conforming uses. As such, the non-conforming uses may <br />continue to exist but if they ever cease and are not replaced with the very same use within 6 <br />months, a conditional use permit would be required to re-establish some use of the buildings other <br />than accessory to the eating and drinking establishment or the retail operation. <br /> <br /> <br />
