CASE AMENDMENT OF CHAPTER 7 OF THE CITY CODE REGARDING CHARITABLE GAMBLING By: Ryan R. Schroeder, City Administrator Background: At the July 23, 1991 Council meeting an ordinance was introduced amending City Code Secuons 7.61 and 7.62 regarding charitable gambling and bingo. It was directed, at that meeting, that the fa'st reading of the ordinance occur and that it be passed to the Budget Comrmttee for further review. Staff also contacted, by letter, the three gaming organizations operating in the City of Ramsey. It was requested in that correspondence that they n:spond to us by the end of October with anv comments. We did receive a visit from the Cystic Fibrosis organization but have not talked with the Anoka Area Hockey Association or the Ramsev Lions in response to our correspondence. Since the July 23, 1991 meetng we have become aware that there have been a couple of State Statute changes which impact our ordinance. The f'u'st is the maximum rental fee that can be charged the gaming organization by the lessor. The second is the investigation fee that the City. of Ramsey can charge is limited to $1'00.00 as opposed to our existing $400.00 fee. Therefore, what is in front of you is a new ordinance amendment which deals with both of these issues. With n:gard to the ~'at issue, we would like to suggest that rather than semng a defined max/mum rental fee, the organizations involved be required to operate as defined bv State Statute. Regarding the second issue of the investigation fee, we are suggesting that it just be stated that there is an investigation fee and that it will be set bv resolution from rime to rime bv the Council. In addition to these, in the fa'st reading we had defined that the gaming profits must be spent within the Ramsey u-adc area. We would also like to amend these two para~m'aphs to direct that. in addition, mn percent of the gaming profits must be expensed for lawful purpose as specifically defined by the City, of Ramsey. Recommendation: In that these ordinances have changed significantly from the ifa-st reading, it is suggested that Council make a motion to reintroduce an ordinance a amending Section 7.61 entitled "Charitabie GambLing" and Section 7.62 entitled "Bingo" of the Ci~' Code. It is also suggested that since this ordinance has already received si~mxificant review and an oppormmD, bx. the orgam:r, ations impacted to comment on it that the second marling of the ordinance appear on a Decem~r Council meemng without further review bx' the Budget Committee. Council Action: Motion to reintroduce Ordinance ..~91-__ mending Section 7.61 entitled "Charitable GambLing" and Section 7.62 entitled "Bingo" of the Ramsey Cirv Code.
