ARTICLE VIII <br /> <br />Termination of Benefits <br /> <br /> Section 8.1. Termination of Plan. This Plan or any provision thereof may be <br /> <br />terminated upon the happening of any one of the following events: <br /> <br /> (a) Upon mailing or posting of a notice by the City of termination of the Plan; <br /> (b) As to a particular Participant, termination of employment. <br /> <br /> Section 8.2. Benefit Upon Termination. Upon termination of the Plan, a <br /> <br />participant's benefits shall terminate and all expenses which would be owing (but are not yet paid), <br />if any, will not be paid. <br /> <br />ARTICLE VIII <br />Miscellaneous <br /> <br /> Section 9.1. Taxation. The City believes this Plan to be in compliance with <br /> <br />§ 125 of the Internal Revenue Code and that it provides certain fringe benefits to employees which <br />are free of tax pursuant to other provisions of the Internal Revenue Code. This Plan has not been <br />submitted to the Internal Revenue Service for approval and thus there is no assurance that the <br />intended tax benefits will be available. Any participant, by accepting a benefit under this Plan, <br />agrees to be liable for any tax that may be imposed with respect to those benefits, plus interest and <br />penalties, if any, as may be imposed by the Internal Revenue Service or the State of Minnesota. A <br />participant may not claim reimbursement for an item or items that the participant has claimed or will <br />claim as a deduction on his or her income taxes. <br /> <br /> Section 9.2. Master Agreement Controls. The master agreement of the <br /> <br />particular insurance company whose product is then being used together with this Plan shall <br />control in defining the persons eligible for insurance, the dates of their eligibility, the conditions <br />which they must satisfy to become insured (if any), the benefits and the circumstances under which <br />insurance terminates, if different from this Plan. <br /> <br /> Section 9.3. <br />the State of Minnesota. <br /> <br />Governing Law. This Plan shall be interpreted under the laws of <br /> <br /> Section 9.4. Auxiliary Documents. Each participant, family member or <br />beneficiary, does, by acceptance of potential benefits under this Plan, agee to execute any <br />documents which may be necessary or proper in the carrying out of the purpose and intent of the <br /> <br />9 <br />12/11/91 <br /> <br /> <br />
