CASE <br /> <br />REQUEST TO <br /> P.I.N. <br /> <br />VACATE A PORTION OF DRAINAGE EASEMENT LOCATED ON <br /> R20-32-25-12-0004; CASE OF R.J.S. BUILDERS, INC. <br /> By: James Gromberg, Project Manager <br /> <br />Background: <br /> <br />The owner of the property described as Lot 2, Block 3, The North Forty 3rd Addition has <br />requested that the City vacate a portion of the drainage easement covering this parcel. City Council <br />directed the Planning and Zoning Commission to conduct a public hearing to review the vacation, <br />receive input and to make a recommendation as to how the City Council should handle the <br />proposed vacation of the drainage easement. State Statute requires that it be found in the public <br />interest to vacate any public way. In the case of drainage easements or a portion of drainage <br />easements, this would include if the drainage easement is no longer considered necessary for the <br />original purpose served under the Grading and Drainage Plan of the subdivision or if drainage of <br />the area could be best facilitated by the use of the existing or remaining drainage easements. <br />Enclosed for your information are the following items: <br /> <br />2. <br />3. <br />4. <br />5. <br /> <br />Site location map <br />Properties notified list <br />Parcel survey showing the portion of the drainage easement to be vacated <br />Engineer's review letter dated November 25, 1991 <br />Notice of vacation for the portion of the easement proposed to be vacated <br /> <br />Observations: <br /> <br />As stated in the attached review letter by the City Engineer, the easternmost 80 feet of the drainage <br />easement may be vacated without major drainage problems resulting. However, vacating the entire <br />150 foot wide drainage easement would affect the drainage of the subdivision. The City should <br />then retain the remaining 70 feet of drainage easement and require it to be graded as proposed on <br />the grading plan for the subdivision. <br /> <br />At their December 3, 1991 meeting, the Planning and Zoning Commission recommended a <br />vacation of the easternmost 80 feet of the drainage easement by the City after receiving input from <br />affected residents at the public hearing. <br /> <br />Recommendations: <br /> <br />City staff would recommend approval of the easternmost 80 feet of the drainage easement located <br />on Lot 2, Block 3, of The North Forty 3rd Addition and authorize the City Administrator to submit <br />to Anoka County the attached Notice of Completion of Vacation Proceedings. <br /> <br />City Council Action: <br /> <br />Motion to adopt Resolution #91-12-__ to vacate the easternmost 80 feet of the drainage <br />easement located on Lot 2, Block 3, The North Forty 3rd Addition. <br /> <br />Review Checklist: <br /> <br />City Engineer <br />Project Manager <br /> <br />Zoning Administrator <br />City Administrator <br /> <br />CC: 12/17/91 <br /> <br /> <br />
