Commissioner <br /> <br />moved the adoption of the following £mdings of fact: <br /> <br /> FINDINGS OF FACT # <br />REQUEST FOR A VARIANCE TO <br />FRONT YARD SETBACK REQUIREMENTS <br /> PIN 28-32-25-33-0011 <br /> 7944 142nd AVENUE N.W. <br /> <br />That Patrick Boedigheimer, hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance from Chapter 9.11.02 Subd 7 <br />(Accessory Uses) on the property generally known as 7944 - 142nd Avenue N.W. <br />and legally described as follows: <br /> <br />Lot 4 Block 3 Alpaca Estates <br /> <br />A public hearing was conducted by the Board of Adjustment pursuant to Chapter <br />9.03.05 (Variances) of the Ramsey City Code on May 23, 1991 and that said public <br />heating was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. Further, that the <br />Applicant did appear before the Board of Adjustment at its special meeting on May <br />23, 1991. <br /> <br />o <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 2.5 <br />acres in size. <br /> <br />4. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Chapter 9.11.02 Subd 7 of the Ramsey City Code states that no accessory <br />building shall be located nearer the front lot line than the principal building on that <br />lot. <br /> <br />That the principal structure on the subject property is set back approximately 305 <br />feet from the front property line. <br /> <br />That there is not a sufficient amount of space between the principal structure and the <br />east property line to construct the building in the east side yard at the size proposed. <br /> <br />o <br /> <br />To construct the accessory structure on the west side yard further back from the <br />front lot line then the principal sumcture interfere with the functions of the set back <br />requirements for the Mississippi River Critical River Corridor and natural drainage <br />area. <br /> <br />9. That the Applicant is proposing to construct a 672 square foot accessory structure. <br /> <br />10. <br /> <br />That the Applicant has stated that the proposed accessory structure will be used for <br />personal equipment storage purposes. <br /> <br />11. That the City did grant a variance for a similar request in 1983. <br /> <br />12. <br /> <br />That the variance is necessary for the preservation and enjoyment of a substantial <br />property right similar to that possessed by other owners of parcels in the City. <br /> <br />13. That the special conditions do not result from the actions of the Applicant. <br /> <br /> <br />
