Commissioner <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br /> RESOLUTION #I0.11. <br />RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO THOMAS <br />KING'S REQUEST FOR A VARIANCE FROM COk--]-~ER SIDE YARD SETBACK <br />REQUIREMENTS IN ORDER TO CONSTRUCT AN ACCESSORY STRUCTURE <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, <br />ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Thomas King, hereinafter referred to as "Applicant", has properly applied for a <br />variance from comer side yard setback requirements in order to construct an accessory <br />structure. <br /> <br />That the Applicant appeared before the Ramsey Board of Adjustment for a public heating <br />pursuant to Section 9.03.05 of the Ramsey City Code on November 14, 1991 and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the subject property is generally -known as 5915 177th Avenue N.W. and is legally <br />described as follows: <br /> <br />All that part of Lot 4, Auditors Subdivision 27 lying west of the following described line: <br />Commence at a point on the north line of said Lot 4,150 feet east of the most northwesterly <br />comer of said Lot 4, then in a southerly direction on a Line parallel with the east 1/ne of said <br />Lot 4 to the south line of said Lot 4, excepting therefrom the south 66 feet of said described <br />property. <br /> <br />-and- <br /> <br />That part of Lot 4, Auditors Subdivision 27 described as follows: Commence at a point on <br />the north line of said Lot 4, 150 feet east of the most northwesterly comer of said Lot 4, <br />then easterly on the north line of said Lot 4 a distance of 17 feet, then south on a line <br />parallel with the east line of said Lot 4 to the south line of said Lot 4, then in a westerly <br />direction along the south tine of said Lot 4 a distance of 17 feet, then northerly to the point <br />of be=oming; except the south 66 feet of said described property together ,~4th an easement <br />over the south 66 feet of the west 167 feet of said Lot 4, Auditors Subdivision 27. Said <br />easement is for road purposes in common ~a4th other users thereof. <br /> <br />4. That the subject property is approximately 0.6 acres in size. <br /> <br />That the subject property is zoned R-1 Rural Residential and is surrounded by R-1 Rural <br />Residential zoning. (3~~.),~\ <br />That the principal structure and attached garage on the prtSperty front on St. Francis Blvd. <br />N.V~. and were constructed pr/or to r. he use and construction of 177th Avenue N.W. <br /> <br />That as a result of the subsequent construction of 177th Avenue N.W., the south side of <br />the subject lot became a corner side yard and the closest point of the pre-existing structure <br />to the 177th Avenue N.W. right-of-way line is 2!.5 feet. <br /> <br />That Section 9.20.11 (R-1 Rural Residential District) states that the side yard setback on a <br />comer lot is 35 feet or conformance ,z4th adjacent setbacks, whichever is =m-eater. <br /> <br /> <br />
