Minnesota Statutes 1990, section 115A.93, 4 subdivision 3, is amended to read: 5 Subd. 3. [LICENSE REQUIREMENTS. I (a) A licensing authority 6 shall require ~-the-extent-p~ss~e that charges for collection 7 of mixed municipal solid waste vary with the volume or weight of 8 the waste collected. 9 (b) A licensing authority may impose requirements that are 10 consistent with the county's solid waste policies as a condition !1 of receiving and maintaining a license. 12 3c) A licensing authority shall prohibit mixed municipal 13 solid waste collectors from imposing a 9rearer charce on 14 residents who recycle than on residents who do not recycle. 15 Sec. 43. Minnesota Statutes 1990, section 115A.93, is 16 amended by adding a subdivision 'to read: 17 Subd. 4. [DATE CERTAIN..] B~ January 1, 1993, each county 18 shall ensure that each city or town within the county requires 19 each mixed municipal solid waste collector that provides 20 curbside collection service in the city or town to obtain a 21 license under this section or the county shall directly require 22 and issue the licenses. No person may collect mixed municioal 23 solid waste after January 1, 1993, without a liuense. 24 Sec. 44. Minnesota Statutes 1990, section I15A.931, is 25 amended to read: 26 115A.931 [B~NB-B~S~SSAB-8? YARD WASTE PROHIBITION.] 27 (a) Except as authorized by the agency, in the metropolitan 28 area after January 1, !990, and outside the metropolitan area 29 after January 1, i992, a person may not ~spo~e-of place yard 30 waste: 31 (!) in mixed municipal solid waste; 32 (2) in a disposal facility; or 33 (3) in a resource recovery facility except for the purposes 34 of composting or co-composting. 35 (b) Yard waste subject to this subdivision is garden 36 wastes, leaves, lawn cuttings, weeds, and prunings. 25
