Police Chief Way commented that Mr. Wellman already had liability insurance in place and <br />would have to with the indoor range as well. <br />He was not opposed to have a proof of insurance condition written into the conditional use permit; <br />however, this was already covered by State Statute." <br />Everyone knows, even the State mandates, liability insurance. <br />They only require liability insurance when there is known to be significant risk of liability. <br />There is risk you just can't mitigate, by putting this next to an operating children's school. <br />It is the wrong location for this type of business, so there are individuals that would obviously benefit <br />from it. <br />Yes, locating the gun shooting range and gun shop in an appropriate B-2 zoning district is the right <br />answer. <br />"The B-1 General Business District is generally more closely interrelated to residential uses then the other <br />three (3) <br />zoning districts listed above. Thus, identifying indoor commercial recreation as a conditional use would <br />provide an <br />additional layer of review to ensure compatibility with the surrounding residential uses. The Conditional <br />Use <br />provides the City the ability to attach reasonable conditions if it mitigates reasonable concerns and <br />provides an <br />additional enforcement mechanism in the event of non-compliance." <br />Yes, the B-1 General Business District is generally more closely interrelated to residential uses. <br />Like a school for children. <br />Not a gun shooting range. <br />You can't really provide enough safety, security, building controls and filters to overcome what a <br />shooting range and gun shop next <br />to a children's school and in a residential zoned area. <br />Risks can't be fully "mitigated" and liability insurance doesn't compensate for safety, feeling safe in a <br />community, or security. <br />Yes, the right answer for the gun shooting range is in the B-2 district (or the country). <br />There is no reason the existing children school (child care facility) cannot continue operating successfully <br />at its current B-1 business location <br />and the expanding gun shop, in creating a shooting location, expand at a B-2 business or appropriate <br />location. <br />4 <br />
