T.C. FIELD <br /> <br />(612) 227-8405 <br /> <br />Dear Workers' Compensation Insured: <br /> <br />As you probably know, reporting of all work-connected injuries is <br />mandated by state law. At this time we would like to remind you <br />that the following state law requirements apply to reporting <br />workers' compensation claims. <br /> <br />The employer is required to report serious injuries or <br />death to the insurance carrier within 48 hours of the <br />occurrence. <br /> <br />The employer is required to report any other work-related <br />injury that keeps an employee out of work for 3 calendar <br />days within 10 days of the occurrence. <br /> <br />Benefits must commence 14 days from the date the employer <br />first receives notice of the injury. <br /> <br />A statutory First Report of Injury form is to be completed <br />by the employer. <br /> <br />The Minnesota Department of Labor and Industry assesses penalties <br />for late reporting of up to $200.00, and depending on the number of <br />days the report was delayed, an additional fine of up to 125% of <br />the amount of benefits that were delayed. Although these penalties <br />may be paid by the insurer, they become part of the employer's loss <br />experience and will affect premiums for the following 3 years. <br /> <br />As you can see, it is exceedingly important to report work-related <br />injuries as soon as the employer is informed of the loss. <br /> <br />Ail employees should be directed to report work-related injuries on <br />the day of occurrence so that you as employer can adhere to state <br />reporting mandates. <br /> <br />To facilitate prompt reporting, we ask you to complete and send the <br />original First Report of Injury directly to your workers' compensa- <br />tion insurance carrier. Please keep a copy of the form for your <br />records and direct a copy to our office.
