§ 9.12 <br /> <br />Performance Standards. Signs <br /> <br />property upon which said sign has been erected, or is in violation of any other <br />provisions of this ordinance, he shall give written notice of such ~solation to the <br />owner or permittee thereof. If the o~mer fails t~ remove or miter the sign sa a~ ~, <br />comply with the provisions set forth in this ordinance within ten calendar days <br />following receipt of said notice, such signs may be removed by the city, the cost <br />incident thereto being levied as s special assessment against the property upon <br />which the sign is located. <br /> <br />9.12.14 Penalties. Each day the violation continues in existence shall be <br />deemed a separate violation. All signs are subject to such penalty for ~dolation of <br />the requirements of the district within which they are located, even though they <br />may not be required by this ordinance to pay a fee or acquire a permit. <br /> <br />9.12.15 Appeals. To provide for a reasonable interpretation of the provisions of <br />tkis ordinance, a permit applicant who ~dshes to appeal an interpretation by the <br />zomng officer or his agent may file a notice of appeals with the ciD' clerk and <br />request a hearing before the Board of Adjustment. The Board of Adjustment shall <br />hear the appeal, make findings, and take its action in the following cases: <br /> <br /> Subdivision 1. Appeals where it is alleged that there is an error in any <br />order, requirement, decision or determination made by the zoning officer in the <br />enforcement of this ordinance; Request for variances from the literal provisions of <br />this section in instances where their strict enforcement would cause an undue <br />hardship. <br /> <br /> Sub~9 Before the board shal] grant a variance, ~t ~s the <br />responsibility of the applicant to prove: <br /> <br /> That there are exceptional or extraordinary circumstances <br /> applicable to the property or to the intended use that do not apply <br /> generally to other property in the same vicinity and zoning <br /> distri ct; <br /> <br /> b. That the variance is necessary for the preservation and <br /> enjo~nent of a substantial property ~gh~ possessed by other <br /> prope.~y in the s~rne vicinity and zone, but ~'hich is denied ~o the <br /> proper~y in question; <br /> <br /> c. That the s%ric~ application of the ordinance would constitute <br /> unnecessaQ' hardship; and <br /> <br /> d.
