January 25, 2014 I Volume 8 I Issue 2
Zoning Bulletin
(Tex. App. Austin 2011), reh g overruled, (Sept. 28, 2011) and review
denied, (Mar. 9, 2012).
onin • ews from Around the
Nation
MICHIGAN
Governor Rick Snyder recently signed legislation that stiffens penal-
ties for failing to pay fines related to blighted property. The new
antiblight laws allow local governments "to add fines, pursue misde-
meanor charges, deny zoning authorization, ban building permits,
garnish wages and foreclose on properties when owners refuse to pay
blight fines."
Source: MLive; www.mlive.com
NEW YORK
The Village of Cold Spring won $75,000 in New York State grant
funds to begin revamping its zoning code by, among other measures:
increasing the stock of multifamily housing (in part to accommodate a
projected 20% increase in population); streamlining the site -plan ap-
proval process for certain projects; and rezoning a business corridor to
cut dependence on cars.
Source: http://philipstown.info
PENNSYLVANIA
The Pennsylvania Supreme Court has declared major provisions of
the state's Marcellus Shale drilling law, Act 13, unconstitutional. Among
those provisions declared unconstitutional is one that allows gas
companies to drill anywhere, overriding local zoning laws. (Look for a
summary of this decision in the next issue of this Bulletin.)
Source: Pittsburgh Post -Gazette; www.post-gazette.com
WASHINGTON
The Metropolitan King County Council has unanimously adopted
legislation modifying King County building codes and development
regulations for the siting of recreational marijuana businesses licensed
by Washington State Liquor Control Board. The legislation, which is in
effect only in the unincorporated areas within King County, sets the
regulations on the production, processing, and sale of marijuana in those
communities.
Source: Kent Reporter; www.kentreporter.com
12 © 2014 Thomson Reuters
