February 10, 2014 ( Volume 8 1 Issue 3
Zoning Bulletin
to Alaska election officials. If a sufficient number of signatures are verified
(30,000 are required), the proposed initiative will qualify for the August
state ballot.
Source: CNN; www.cnn.com
COLORADO
As of January 1, 2014, the sale of recreational marijuana to anyone age
21 or older is now legal in Colorado.
Source: CNN; www.cnn.com
PENNSYLVANIA
The Commonwealth of Pennsylvania has asked the Supreme Judicial
Court of Pennsylvania to reconsider its December decision that struck
down parts of Act 13 as unconstitutional (see case summary in this
bulletin). Reportedly, the Commonwealth is asking the Supreme Court to
remand the case to a Pennsylvania court for further evidence, exhibit and
testimony gathering.
According to a press release from Governor Corbett's office, the
Supreme Court's decision represents a "stunning departure from the
historical practice of that Court, and an unrestrained venture into a fact-
finding role that the Court always has insisted is not its proper place in the
judicial system." Accordingly, the Commonwealth is seeking "remand
[of] the case to Commonwealth Court for the development of an eviden-
tiary record. . . application of the Court's newly -pronounced standards to
the facts as found by the Commonwealth Court . . . and finally a fair and
final determination as to whether Act 13 violates [the Environmental
Rights Amendment] based on a full record and formal findings."
S ources: Reuters; www.reuters.com; Lexology; www.lexology.com
12 © 2014 Thomson Reuters
