Subdivision 1. The governing body of the Commission shall be its Board. Each <br />me1berMember shall be entitled to appoint one representative on the beafElBoard, and one <br />alternate who may sit when the representative is not in attendance and said representative or <br />alternate representative shall be called a "Commissioner" and "Alternate Commissioner", <br />respectively. <br />Subdivision 2. The councilCouncil of each memberMember shall determine the <br />eligibility or qualification of its representative on the CommissionCommissioner and the terms of <br />each Commissioner shall be as established by each individual ffreniberMember. <br />Subdivision 3. The term of each Commissioner and Alternate Commissioner appointed <br />by each mel ierMember shall be as determined by each individual mexberMember and until <br />their successors are selected and qualify. <br />Any vacancy shall be filled for the unexpired term of any Commissioner by the <br />councilCouncil of the governmental unit of the mcmbcr whoMember that appointed said <br />Commissioner. The Commission shall notify the Board of Water and Soil Resources of member <br />appointments and vacancies within 30 days after the Commission is notified by a mcmbcr. Each <br />membefEach Member agrees to publish a notice of vacancies resulting from the expiration of a <br />Commissioner's or Alternate Commissioner's tersterm or wherowhen a vacancy exists for any <br />reason. Publication and notice shall be in accordance with Minnesota Statutes, Section <br />103B.227, Subds. 1 and 2, as they now exist or as subsequently amended.2. <br />Subdivision 4. The council of each memberEach Member agrees that its representative <br />commissionerCommissioner will not be removed from the Board prior to the expiration of the <br />Commissioner's term, unless said Commissioner consents in writing or unless said <br />councilMember has presented the Commissioner with charges in writing and has held a public <br />hearing after reasonable notice to the Commissioner. <br />A iffembefMember may remove a Commissioner or an Alternate Commissioner for just <br />cause or for violation of a Code of Ethics of the Commission or a member CityMember, or for <br />malfeasance, nonfeasance, or misfeasance. Said hearing shall be held by the Member—City <br />Council whothat appointed the Commissioner. <br />A Commissioner who is an elected official of a Member-Giy, and who is not reelected, <br />may be removed by the appointing Member-Gity at the Member's discretion. Any decision by a <br />Member to remove a Commissioner may be appealed to the Board of Water and Soil Resources. <br />A certified copy of the Council's Resolution removing said Commissioner shall be filed with the <br />Secretary of the Board of Commissioners and shall show compliance with the terms of this <br />section. <br />Subdivision 5. Each fReffiberMember shall within 30 days of appointment file with the <br />Secretary of the Board of Commissioners a record of the appointment of its Commissioner and <br />its Alternate Commissioner.
